Can I offer another perspective?

The H visa people use the term 'consular processing' frequently. Maybe the OP has transferred over the lingo he is familiar with.

But I can't for the life of me figure out why an H1-B would go for a K-1 visa. That lawyer might be a good investment (if you count 'time' as something to be saved).

I suspect that reddy understands that, the I-129f petition has been submitted. For that reason it seemed clear to me that reddy was talking about the visa interview that would follow approval of the petition.

My whole premise in this discussion is that there is only one roadmap to obtaining a "K" visa. You cannot ignore, avoid, skip or shortcut the process by trying to go directly to the consular phase. The OP indicated that he was going for "consular processing". I interpreted that as trying to start the application directly at the consular phase without following the roadmap. That cannot be done!

I googled attorneys for K1/K2 and found someone called Holmes and Lolly. Seemed very professional when we talked. Later I saw many postings on them being in some fiance rackets and that they are not thorough with their work... Any feedback anyone? Or can you recommend a good attorney you have used in California or elesewhere.

I am currently using Holmes & Lolly and have nothing but praise for them. My case is moving alone at a better than expected pace.

Sept. 2004 thru April 2006 ongoing relationship

Went back to Mumbai April 2006

Engagement April 2006

10-05-06 NOA2 (51 Days)

10-19-06 NVC received my petition (Please hurry, so she can be here for Christmas)

10-26-06 Received NVC letter stating it was sent to Mumbai (Letter dated 10-23-06)

12-09-06 Never received Packet 3, So we downloaded and sent to embassy

02-02-07 INTERVIEW (Missed 1st interview, waiting on new interview date)

04-02-07 New INTERVIEW Date.

04-02-07 APPROVED !!!!!

04-27-07 ARRIVED IN U.S.

I cannot make that leap that the petition has been submitted. If so, why does he need a lawyer because most of the hard work would be done.

I did re-read his post and can see where I might have misinterpreted. He indicated that he would return to India for consular processing phase and then return to the US on the K-1. My bad.

It's not much of a leap - he's written in his profile that he's submitted the petition.

Some people find that the visa application is more problematic than the petition. (At some consulates it's hell - read some current threads!)

Thank you all for your suggestions and references.

Perhaps I used to word "consular" a little differently/ incorrectly. In most cases, the fiance is outside the US and the USC starts the process here. The fiance then gets the visa at the consulate in their home country.

I on the other hand have been in the US for 7 years now. I have a H1 visa and an employment based green card in process. However, I am going in for the K1/K2 because of my son. On the H1/H4 route with current processing times, he is most likely to get aged out even with CSPA provisions. Hence the K option. When I said "consular" I meant, not being able to convert from H to K here in the US, but actually going back home to the consulate there to get the K visa.

Also, can you please confirm who is who in your relationship? You are the alien? Are you the fiance or the fiancee?

NOW a K for an H makes sense. :)

If your son is that close, double and TRIPLE check that your plan will work.

There's a horrible ongoing saga here of a woman whose entire family has adjusted, except for the one son. There is no clear policy on what happens for 20 year old Ks.

Be sure you've explored ALL the options (you don't happen to live in Dallas or Oklahoma do you? Look up "DORA"--there is one other city in this rapid adjustment test program).
