I googled attorneys for K1/K2 and found someone called Holmes and Lolly. Seemed very professional when we talked. Later I saw many postings on them being in some fiance rackets and that they are not thorough with their work... Any feedback anyone? Or can you recommend a good attorney you have used in California or elesewhere.

Just afraid of making a mistake. I am currently in the US on a H1 visa and my son on a H4 visa attending college. We plan to go for consular processing and return on a K1 and K2 visa. Any mistake I make would end up getting him stuck in India and out of college! Hence the caution. Thank you though...Money saved would have been good.

Hi first i have to tell you i used one but right now i know they are useless any time you call they don't know any thing only you have to wait until six month time frame is passed but they are good when some thing goes wrong. if some thing goes wrong its very hard to fix only a attorney can fix it this is my opinion.

The K1/2 can only be petitioned by the USC via the USCIS.

Start with the attorney search function on the AILA web site.

Matthew Udall is an excellent K-visa attorney in the LA area, an immigration attorney does not necessarily have to be local - it's more important that their expertise match your needs.

Don't confuse petitions with visa applications.

What I should have said is the the K1/2 process is started via a petition to the USCIS and is not a visa that is applied for and processed directly via the consulate

Yes the process is started with a petition to the USCIS. And yes it is a visa that is applied for and processed directly to the consulate.

A petition is not a visa application. It is a distinctly different, if related, beast.

We are getting into ####### semantics here but a k-1 is not a visa that I as a USC can walk into the consulate off the street and submit a application directly to them like I can a DCF! That is what I mean.

Another thought - Google the Usenet newsgroup <alt.visa.us.marriage-based> and search for posts by folinskyinla on the subject. I believe that he has suggested a few immigration attornies in the San Francisco area.

You as a US citizen cannot walk into a consulate and submit a visa application for any kind of visa. Well, I suppose you can, but why would you?

It's not semantics, ####### or otherwise - a petition is not a visa application.

ive read that an attorney has nothing to do with the processing of visas, they can help on teaching u what to do and prepare..but when the USCIS got ur papers, we dont know the time frame when they will have the case sent to Nvc or to ur USE...no other people can make the processing faster, just pray that the people responsible for the review of ur papers will do the work diligently and faster :)

No it isn't but in "K" world it is foreplay to the application.

My whole premise in this discussion is that there is only one roadmap to obtaining a "K" visa. You cannot ignore, avoid, skip or shortcut the process by trying to go directly to the consular phase. The OP indicated that he was going for "consular processing". I interpreted that as trying to start the application directly at the consular phase without following the roadmap. That cannot be done!
