Timeline

Ok, my Husband got here Sept 6 2012 on his K1 Visa, we got married on October 21, 2012. We still need to file the forms for his AOS, but since it asks for proof of residency and marriage, such as bills, well he has none of that, he doesn't even have a state ID yet. His I-94 says it expires on Dec4 and his visa on jan 26, 2013. We are trying to get him atleast a state ID so i can add him to my bank acct( for which they require atleast his state ID) and the lady at the Drivers license place said that if he got an ID it would only be valid until Dec 4? and that since it takes 2 weeks to get here in the mail that it would be expired by the time he got it,and that he would need to get an extension for his I-94 but for K visas you can't, atleast from what i read. Should I still try to get him his State Id so that I can add him to my bank account or should I just forget that and file this stuff now.

Oh, hmm, well I know we need to send his stuff off before the I-94 expires, so should we just forget about the ID for now? What are some other ways to show his proof of residency at the address??

And once the I-94 expires do we need to do anything or submit anything anywhere else?

Answers are greatly appreciated.

April 16 received second NOA.

May 14 received letter from American Consulate General

May 18 sent packet to fiance

June 20 fiance finally received it (postal ppl had it there since beginning of june, but told him they didnt)

july 30 They issued his Visa :)

September 6 arrived in Texas

October 21 got married :)

You do not need bills, joint accounts, etc. to adjust status from a K-1. All you need is a copy of the certified marriage certificate.

Also, the expiration date on the K-1 visa became irrelevant once your husband entered using the visa. The date that controls is the date on the I-94.

Form field input font changed to allow entry of dates in the specified format and to provide more space for addresses and employment history. This is the 6/12/09 version of the form; the current version is 8/8/11, but previous versions are accepted per the USCIS forms page.

we got his SSN already also. :) and ok, hmm, as far as his birth certificate, since its in spanish does it need to be translated or original language is ok? and are there any websites anyone recommends for that?

You'll need to include a translation. If you or he are competent in both Spanish and English, you can do your own translation (though it's better to get a third party to sign off on the accuracy). The USCIS recommends the following "certification" language:

Certification by Translator


I, [typed name], certify that I am fluent (conversant) in the English and ________ languages, and that the above/attached document is an accurate translation of the document attached entitled ______________________________.

He can get a state ID with his SSN and EAD. It takes about 2-3 months to receive EAD/AP after you file for AOS. The only proof you need to send with your AOS paperwork is a copy of your certified marriage certificate. If you end up getting called for an interview, then you would bring evidence of co-mingling. If one of you is fluent in Spanish and English, then you can translate it yourself. My husband translated his own birth certificate using the certification from USCIS posted above in this thread.

Based on Vanessa's post, I made a PDF check list that you can download from this other post http://www.visajourn...65#entry5687165

The only line that may be different for you is where it says "Pay Stubs/ LES" because I did it for myself ... so there, for most people would be "Pay Stubs / Employment letter" (basically the evidence you need to present for the I-864 according to the instructions http://www.uscis.gov.../i-864instr.pdf )

BTW: To avoid confusions, if you see that I mention the proof of bona fide marriage on my post it's because I'm a tad OCD tongue.gif and I was thinking ahead of time.

as I know, you will need bank statements and other stuff for the interview, not now, i mean not while you are filing your aos application. As for the joint bank account, we also tried to add my name to it but the manager said to wait until i get my work permit or EAD and bring it together with one more ID which can be a library card or a phone account. So, you can find out about it in your bank
