Processing visa at consulate in third country...

Hello everyone

My fiance is American and I am from the UK. We're currently waiting for our NOA2 from the VSC. Our NOA1 date was May 1st 2012. We can see that other people who have NOA1 dates after us have already received their NOA2 so this is causing us to wonder what is going on.

Our situation is a little different to other peoples. We have been living and working together, in both South Korea and China, for the past three or so years. We filed our application soon after we moved to China when we got engaged. We heard at the time that processing the visa in China takes three months longer than usual due to extra processing at customs so we opted to complete the visa process at the US embassy in Hong Kong.

With everything that is going on, we are now worried that this was a bad decision. We need to know if it is possible to process a K-1 visa in Hong Kong, which I would visit on a tourist visa. I would have have no ties to the country as our work visas are only for Mainland China and we aren't residents.

We're hoping that someone can put our minds at rest with this issue. If someone has been in similar circumstances and processed a K-1 visa in a country other than the place they have residency or where they work then please let us know.

This has nothing to do with why you still haven't received your NOA2: petitions are all reviewed at USCIS in the USA, unless you submitted your application directly to the consulate in China, is that what you did? Somehow I doubt that that's the case.

Welcome to the forum.

Please remember the statement at the end of question 20, on page 2 of the Form I-129F petition:

"NOTE: (Designation of a U.S. embassy or consulate outside the country of your fiancé(e)'s last residence does not guarantee acceptance for processing by that foreign post. Acceptance is at the discretion of the designated embassy or consulate.)"

Additionally, there have been recent forum threads about folks attempting to move their interviewing embassy/consulate, only to have the petition sent to the wrong consulate, resulting in further grief and delays in processing.
