Arrested for drug use, but charged of disorderly conduct

Hi all,

I'm european and last year i came to NY for 10 days. While having a good time in a club, someone proposed cocaine, which i accepted - stupid i know. I didnt have the time to try the drug but already i was cuffed and arrested by local police. I spent the rest of the night in the police station's jail, was fingerprinted and in the morning was taken to the manhattan court jail for an extra 8 hours until presented in front of a judge. I pleaded guilty to disorderly conduct and the judgement was that i had to pay 220$. It is extremely clear in the court report that provided i pay the fine there will be no case open. I payed the fine of course.

Anyhow, when i got back to europe i went to the us embassy to create a visa, making sure the embassy was aware of my little story. I obtained an R visa b1/b2 which i understand to be the regular visa for us immigration.

Now i need to get back to the us.

My question is simple : what do i tick under "Have you ever been arrested or convicted for an offense or crime involving moral turpitude or a violation related to a controlled substance......" On the immigration forms given there is no case ?

And second question : if i tick yes, will the border police ask me what happened ? And can they refuse me entry even though i have a visa ?

I think the only option you can check is yes.

And yes they can refuse you entry even though you have a valid visitors visa.

Since you were arrested in the US they already know about the arrest as soon as they pull up your name. So click yes

And yes, you can be denied entry even with a valid visa

So you have an R visa (religous) or a tourist visa? Please clarify since you reference both

You said you obtained a visa, and are talking about clicking boxes. Are the boxes on ESTA? Because you do not need to fill out ESTA if you have a visa. If you see that box anywhere in the future, you must tick YES or you will be banned from the US for life for lying.
