I am a US citizen, my husband is a permanent resident, and my 12-year-old stepdaughter is here visiting on a tourist visa like she does every year. This has been her longest stay because she wanted to attend school here in the US for half the year. Her 6-month limit is up on January 4th, but she has now decided she wants to stay and finish the school year. I really need help knowing what process we need to go through and what forms I need to fill out to adjust her status. Will this be a problem? Any help anyone can give would be greatly appreciated! :help:

Aug. 29, 2008-K1 application filed by our attorney

You can petition your step-daughter as an immediate relative since you married before she turned 18. She will file for AoS in the normal way.

Does she need Form I-693 (Report of Medical Exam and Vaccination Report)sent with the I-485 since she is already in the US, or is a vaccination record sufficient?

By the way, she isn't authorized to attend public school in the US on a tourist visa. It's not grounds to deny her adjustment of status, as far as I know, but it's not one of the permitted uses of a B2 visa. In fact, it's specifically prohibited to take any classes that are "for credit" or more than 18 hours a week. It's highly unlikely USCIS will do anything about this, but if they notify the school district and the district decides to get snotty about it then they could charge her tuition as a foreign student for the time she was enrolled.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
