Hi

I have now been waiting 17months after my interview for my IR1 to get accepted (green card), this is too long, I am UK citizen (born and bread), never committed any crime (as my police report shows; which was given to the US consular at London Embassy), so I don't understand how can they take this long and allow people like me to be without there family (my spouses family), i have not seen them 4 over 2 years, what can i do as waiting is making me loose my mind, I'm thinking of not wanting to live anymore, can i write to secretary of state or anyone else for some support? any help please will be appreciated, thanks

I'm sorry to hear of your frustration over this whole process.

Firstly, the more information the vj community gets, the easier it is to help give advice for your situation. Please file in your time line.

Secondly, especially in this sub-forum, you'll see a big mix of people who have been waiting for long periods of time based on a lot of reasons: previous overstays that require a waiver, AP for missing documents or additional sponsors, AP for name checks/security reasons, or extended AP based on individual consulates internal procedures. Once we know more about your specific case, we can help advise you.

#1 - Has your spouse called her senators/congress person to find out via their immigration liaisons what is happening with your case?

#2 - Has your spouse called DOS to inquire what is holding up the case?

#3 - Have you used an attorney with this case and been following up with their offices to see what is going on?

#4 - Were you given any paperwork at the end of the interview that explains what the next steps are?

Other things that will help us help you - is there anything about your case or relationship that could be seen as an outside factor. You mention you are a UK citizen born and bred - were your parents immigrants to the UK? We have seen a least one case [for a fiance visa] where the UK man is sitting in AP as his family is Pakistani and they have requested detailed travel information from him. How about anything that would be considered a "red flag"? This may include non-traditional age differences [usually the wife being older], multiple marriages [especially if past marriages gained the sponsor US citizenship], short trips or a very short courtship with marriage during the first trip?

In general, we need a little more info to help you out!

Is your spouse U.S.Citizen? If so they should contact their congressman and call washington state at 1-202-663-1225. They can look up case info. Are you in AP? It is a awfully long wait for a visa after a interview.

While not the longest, it is an unusually long time in AP. Did they tell you what the AP is for? Did your spouse contact her elected representatives?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I have travelled three times before to USA on the ESTA program but when i tried to travel again they cancelled it without informing me, in addition at the interview the consular thought i was born abroad even though my birth certificate was in the consulars hand, i have still not heard from them; still waiting, the bullet points above; my answer is yes to all, all those people have been contacted and the answer given back was: its still pending (nothing can be done even through them senators/congress), attorneys cannot do nothing when a case is in AP, DOS they say the same always: its still pending call back, I was given a white paper after my interview and was told once AP is done i will be contacted, that's all, i hope you guys could shed some light on this, by them making me live life this is not right at all, thanks

Your spouse can write to the President of the United States by going on the White House website. They will forward your case to the Department of State where they will look into it and get back with you. Make sure to give them names and the embassy case number and home address. It will take about 30 days to get a response.

My husband was in AP for 16 months so I know the pain you are in.

Is your husband now with you in USA? and who responded to your case was it the President Obama or the Department of State? how did it go in your husband case can you please give a bit more info if you dont mind, and is the response definately in 30 days time? thanks

i understand why AP is done which i agree with 100%, but still it shouldn't have to take this long with me, my police report is CLEAN they have seen it, why keep families apart for such long periods, as i said above I'm born and bread in the UK; thus my info should be accessible for them easily, the amazing thing is no one can help not even US Embassy in London or DOS when called or emailed, I'm sure me waiting for this long must be going against my human rights as i should be allowed to be with my family, in addition the 221g is unconstitutional because it violates my spouses right as a US Citizen; due to process and the pursuit of happiness.

If you are going to get into US Constitutional Law perhaps you could be a bit more specific.

As an Alien outside the US you have no rights, and the Constitutional is silent on the any right for a US Citizen to bring in a spouse.

You can get your USC other half to make enquiries through their representatives, if it has been lost that could help.

If it is still in process, then nothing, there have been many queries and nobody has a magic solution.
