GC for son born abroad

Timeline

I am a GC holder.

M wife is an American citizen.

Our second child was born in Canada a month ago.

Currently we live in Egypt for some time due to family issues.

What is the easiest way to apply for GC for our son?

Since your wife is a US Citizen, your son can get US passport. Contact local US embassy/consulate in Egypt for more details.

Yes....as everyone says, since your wife is American, your baby is entitled to citizenship. Our daughter was born in Egypt, and she is a citizen. You have to set an appointment at the embassy in cairo to report a birth abroad, and apply for the passport. Bring all the birth certificates and evidence of your marriage and such, and you will be approved. Check the embassy website for the forms and details...but it was fairly easy for us to do, and we got our daughters birth certificate and passport two weeks after our meeting with the Consular at the embassy.

N.B: My wife is US citizen (did not fulfill physical presence in USA in order to pass citizenship for our son)

You are LPR,

Wife is a LPR,

Baby born in Canada but you posted under a Spouse visa with a Egypt flag?

If wife is a LPR, baby born aboard due to?

Consult the US Consular in Canada to see what is required to you to bring the baby back to the US.

If your wife (a uscitizen)

is the child's mother,

then the fastest way is for HER to file an I-130.

If she didn't meet the minimum residence criteria (I think it's 5 years), then she may need to file the I-130 for your son.

I don't believe anyone is granted a green card at the port of entry without applying for it. I believe your wife will have to submit an I-130 for him if you are planning on moving to the US.

How long was she resident in the US prior the birth of the child?

What's the whole situation? When did you become a resident? When did she live in the US? When and why did she have her child in Canada?

I got my GC in Sept 2011

Our second child was born in Canada while I was there wrapping up a research project over there.

Our 1st child born Canadian as well. She got USC according to Child Act 2000.

No, your child does not have claims to a green card at a POE, one must be applied for

good luck

Our 1st child born Canadian as well. She got USC according to Child Act 2000.

This is a weird predicament. You were only in Canada to complete a project and now you both need to move back and you can't because your child cannot enter the US without a status. The child would not be a visitor because you intend to live in the US once your project is done. When do you plan on moving back to the US? 3 months, 6 months, 9 months? If you can wait 9 months, then your wife could apply for permanent residence for them. She would need to petition for your child.

If you can't I'll search and see what I can dig up. Keep looking, and try not to double post.
