Hi everyone, I have finally gotten the AOS packet together and have the funds to send it tomorrow! My only real questions are concerning the AP. My husband has been here since Dec. 24, 2011. His I-94 expired on March 23, 2012, we were married on March 7, 2012. I was reading something about 180 days and I am little confused about it. Can I still file AP or will it just be denied since he has been here over the 180 day mark? Any advice would be helpful, thanks!

8-5-11: I-129F sent via FEDEX Ground to Lewisville, TX Lockbox

8-9-11: Delivered to Lewisville, TX Lockbox Signed for by CVILLEGAS

8-11-11: NOA1 Email/Text :)

8-12-11: Check cashed!

8-12-11: Touch.

9-20-11: NOA2. 40 days after NOA1.

12-15-11: Interview and APPROVED!!

12-24-11: POE in Philadelphia!

AP is always granted if you are eligible for it. Since he has six months of overstay right now then it will trigger a 3 year ban from the US as soon as he leaves that the AP will not overcome.

Again: he should not travel internationally until his green card is approved.

In your situation I would pull the I-131 out of the packet and shred it, since it is essentially worthless to you now.
