did i make a big mistake by filing the I-129f

i am so piss i never found this site earlier, me & wife (we are married now over 2 months) and we file the i-130 then last week we mail the i-129f... now i am so piss :angry: we file & mail the i-129f for the spouses K3 visa intend of a IR-1 / CR-1 FORM which i never knew bout til i came on this site :wacko: and from reading a few post its looks like we will put at the back of the line and might be 10-12months before anything gets approved wow wow

my wife do have a u.k passport with a visa waiver & also a visitor visa in her native island passport (which she only use when going to the near by islands ) and i would like her come to the united states for the Christmas/new years but i not sure if they let her come now that we file both forms ,she always use the u.k passport to come back & forth but that was before we got married i want to know if its better for her keep using the u.k passport til your file get approved ,which will cost us some money with flights but if she travel on the visitor visa she can stay a little longer then head back home which would be better for us on money and saying good bye

Sept.12 2012- got Married to my best friend(Ms.Keyzz)

Nov.01 2012---- my wife went back home

Nov.08 2012---sent I-130

Nov.13 2012-- I-130 Case accepted and routed to U.SCIS National Benefits Center for processing

Nov.24 2012-Received R.F.E I-30

Nov.26 2012--Sent I-129f

Dec.24 2012--wife came back up for Christmas & new years

2013-01-04---I-130 approved

2013-02-04 ---send a letter to Cancel I-129f (can't remember date )& decided to file I-485

2013-04-15-sent I-485, I-130 approval hard copy and I-765 applications to lock box, Chicago, IL

2013-04-20- came back with a note stating the amount was wrong

2013-04-22- i-485 packet send to lock box, Chicago, IL ( the correct amount this time)

2013-04-25- email saying Case I-485 Case accepted

2013-04-29: Received both I-485 and I-765 NOA's hard copy in the mail and the Biometrics appointment letter

2013-05-21: Biometrics done & stamp on my I-797c

2013-05-31: check case on the USCIS web page & its said (your I-485 status is ready for Testing and Interview schedule ( NO EAD CARD)

2013-06-10-hard copy interview letter was mail( NO EAD CARD)

2013-06-12:case updated from testing & Interview schedule to Testing and Interview ( NO EAD CARD)

2013-06-15-Got hard copy A.O.S Interview letter in hand dancin5hr.gif( NO EAD CARD)

2013-07-10 - got a letter from NVC with a case number ( which we cancel from 04. feb. 2013)

2013-07-17- A.O.S approved on the spot ( less then 20 mins)

2013-07-18- Green Card was send out by usic

To keep a long explanation short, both petitions that you filed will be tied together and adjudicated at the same time. If both are approved, they will likely be sent to the NVC at the same time and in turn, will arrive at the NVC at the same time. If both petitions are received by the NVC at the same time (or if the I-130 arrives first), the K3 process will be administratively closed by the NVC and the CR-1 process will remain active.

Your wife can continue to use her UK passport to visit the US while this process is pending, and she can also visit during this time. However, there is no guarantee that she will actually be admitted to the US by CBP. She should bring proof of strong ties to the UK in case CBP asks to see such ties.

July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Ryan covered things pretty well. All I would add is that, at most, filing the I-129f will cost you a few weeks, it is not a huge delay. All going well, your wife should have her visa in 8-10 months.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

The K-3 will not largely delay your case, but it will certainly not speed it up. It will probably be decided for you when NVC closes the I129F but in case they don't, I'd stick with the superior (and cheaper) Cr-1 visa path

she was born in & live in the British virgin islands that how see got the u.k passport & the virgin islands have usvi/bvi visa initiative that how she got her visitor visa in her British virgin islands passport.,that why i was wondering if its best for her to use her British virgin islands passport knowing that it has a visa in it but she never using to use it that the thing...

You were on it already... I'm not sure what you would do to tell the NVC you do not want to pursue the K-3 and just stick with the CR1 if for some amazing reason they don't close the I-129F (which they do... almost all of the time in which case you don't have the option for the K3 at all.)

Correct, however, everything we have been saying about the joint processing of I-130 and I-129F since late 2006 may well be out the window, now that the I-130 petitions are going to NVC for assignment to local field offices for adjudication. We really don't know yet what is happening to I-129F petitions now.
