My fiancée and I were looking into to changing from the K1 fiancée visa to the spouce visa. We only in the last 2 weeks done the I-129F petition and sent it off. Shes currently visiting me here in Canada and we were looking into the spouse visa. It seems that the spouce visa would allow me to work when I enter the states and would also get me settled faster. Is there any drawbacks to changing from a K1 to a K3? Anyone ever done this can give me us some advise?

Spousal visa isn't the K3, it is the Cr-1 now (espeically if you are looking to work right away)

Downside? Losing the time and money you've already invested in the K-1

Good luck

So if we file the cr1 would it be better for us than file for a K1? I have a father in Ireland who is very sick and might die before Christmas 2013 I need to be able to come and go as I wish if he takes a turn for the worse then I need to get to him. I also need to keep an income as well for myself in case my dad ends up passing away.

With how fast the I-130 appear to be moving, I'd say go ahead with the CR1.

We also switched from a K1 to a CR1 and in my opinion, it was a good decision because of the work/travel issues.

good luck

PS - just so you know Montreal is the only consulate that does the Cr-1 interview. In case you are looking to interview in Vancouver for the K1
