Hello. Please read our STORY.

:help: :help: :help: :help:

On November 22, 2012 we had our Medical at St. Luke Extension Clinic. So, my sister, my brother and I are petitioned by our mom who is a LPR. My sister and I, were done with the medical but my brother is not. During his physical examination the doctor asked him some question like :

1.What is his name.

2.How old is he?

3.Did he used drugs before? My bro is 17 yrs old. The doctor was pressuring him , making him all nervous. :crying: :crying: . And so my BROTHER Admitted that he USED it ONCE (marijuana) but it was 3 yrs ago. It was because his friends were pressuring him to try it but it was just a one HIT then he gave it back to his friends. After that one TRY he NEVER DID IT AGAIN. After that, they send him to the "N" area and a psychologist gave him a paper to sign..so he answered it. They give him an appointment to do a Psychological evaluation/ personal evaluation on DEC.4,2012.

Does this mean that his F2A visa will be automatically denied? Is it true that he would be BAN for his entire Life to enter the USA? Is there anything we can do? this is the biggest challenge in our life right now. My mom hasn't stop crying and she is worried about this. Please help us. If ever he get denied, can we apply for a WAIVER. THank you so much for reading and please help us. It is very stressful for our family right now. By the way our INTERVIEW at the US embassy in manila is on December 26,2012. :help: :help:

Hi! I'd say don't worry too much. As long as he passes both medical and psych evaluations AND the interview, the embassy has no reason to deny him a US visa.

However in my sister's case, she also did drugs when she was a teenager and went through the same psych test/eval during her medical. She did the medical TWICE on different dates. When we arrived in the US, she was only granted a 3-year conditional green card, instead of the 10-year green card without conditions. Though it's not much of a problem since when she renewed her green card, she was already granted a 10-year non-conditional green card.

Nov 3, 2012 - Sent I-130 to Phoenix Lockbox

Nov 5, 2012 (PD) - I-130 forwarded to California Service Center

Nov 10, 2012 - Received NOA 1 hardcopy

Present - "Inital Review" stage

Was your sister a minor too when she did the medical at SLEC?

What if the applicant has been treated or hospitalized for psychiatric or mental illness, or alcohol or drug abuse?

Applicants treated or hospitalized for psychiatric or mental illness or alcohol or drug abuse must present written certification including the diagnosis, duration of treatment rendered, and prognosis.
