Hi guys,

I have a question maybe you guys can help me out. My dad is the joint sponsor for my wife coming over to the US. I am living with both my parents. His income alone is enough to fulfill the requirements. Does he need to fill out a I-864 and I-864a?

He needs to fill a I-864. If they file taxes jointly, your mom/ his wife needs to fill in I-864A

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Only one of the replies was correct, the second one. Unless you are a dependent of your parents on their tax return, it doesn't matter where you live. You file an I-864 regardless, because you are the petitioner and primary sponsor. Your father files his own I-864 and an I-864a for his wife, as his household member. Filing an I-864 is the only way the qualified joint sponsor can accurately and completely state their household size.

Facts are cheap...knowing how to use them is precious...

Thanks you for your help..that cleared up some of my confusion regarding i864 and i864a. Just another question..what if my dad files his tax separately from my mom, do we still need the i864a for her? or just one i864 from me (the primary) and one from my dad (the joint sponsor)?

He must also include his recent paystubs it helps them determine his individual income because he probably files a joint tax return. Employement letter is optional but its a good back up that tells them you and your dad has a job and what you make and that you will be remain their employee.

Thank you! I have my tax returns and w2 from 3 years ago (2009) however I am currently self-employed for the past 2 years (2010-2011) so i don't know how i would get the employment letter for myself. I do do my taxes every year and have my tax returns to prove it. As for my dad we got his pay stubs ready and also a formal employment letter from his employer. Also we included another copy of my birth certificate to show my relation to my dad. Would that be enough documents concerning the AOS packet? should i include a copy of my business license?

This is wrong. Please disregard. The I-864a is for people needing to combine income. That does not apply here.

This is wrong. Please disregard. The I-864a is for people needing to combine income. That does not apply here.

If your father does not file a joint tax return, there is no need for an I-864a from his spouse.

What if he file a joint tax return for 2009-2010 w/ my mom but file separately for 2011 (most recent). however his income from his work alone is about 44k /year which should be more then enough as a joint sponsor w/o needing to combine income.

I filed IR-1 for my wife and I am currently at the NVC stage. I applied a Tax ID number (ITN) from the IRS and added her to my tax return (as joint our both names are shown on the tax return). Do I have to use I864 or I864A. By the way, I used form I864 and mailed it to NVC on November 13 and so far, I did not hear from NVC. FYI, my wife is in her country and waiting the completion of our case at NVC.
