Application for SSN After Marriage

I arrived to US on the K-1 Visa and just got married on November 10, so now we're putting together all the forms for AOS now. Do I need to have an SSN before I file these forms?

If so, there is a section on the SSN application form that states:

'If you check “Legal Alien Not Allowed to Work” or “Other,” you must provide a document from a U.S. Federal, State, or local government agency that explains why you need a Social Security number and that you meet all the requirements for the government benefit.'

What kind of document would qualify for someone in my situation?

You do not need an SSN to file for AOS. You should go ahead and apply for it though while the I-94 is still valid. It will be needed for other things and you will already have it when you get your EAD after filing for AOS. You need the EAD and SSN to be able to work while waiting for the green card approval.

A K-1 is a legal alien allowed to work. That is what you check on the form.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

A little suggestion;

if the SSA employee can't find you in the database, offer to withdraw the application and come back after a week. Or you let them figure it out and it may take several weeks if they cannot find you in the database. You'll need ssn(or a note saying your ineligible to receive ssn) if you want a state ID or driver's license. SO it might be a good idea to get ssn before the i-94 expires. While the driver's license expires when the i-94 does, I was happy that I didn't have to do through anymore of that stuff when finally getting EAD. It was a matter of renewing and that was it.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

EAD/AP Approval took 51 days from NOA1 date to email update. (77 days from filing until EAD/AP in hand)

AOS Approval took 206 days from NOA1 date to email update. (231 days from filing until greencard in hand)

Good suggestion, I have another:

If SSA is unable to verify your data in the CBP I-94 database, they will generate a letter basically saying, …."We acknowledge your application for a SSN. Before we can issue you a card, we must verify the document (I-94) you gave us showing your Alien status with the (Federal) agency that issued that document"…. My employer's health insurance carrier required a SSN to enroll my wife into the program. I sent the SSA letter to the HR folks at my company, they were able to extend health insurance coverage to my wife pending SSN issuance.

In our case this was a good thing, as that it took CBP over six weeks to input the I-94 information into their database. Her health insurance coverage was retroactively effective the first of the month. During the month she had her immigration physical and vaccinations that I had paid out-of-pocket. I was able to provide her insurance information to the rip-off Civil Surgeon and was able to get reimbursed for the majority of the cost of her CS visit.
