hello ... I'm corrado .. can you give me the answers ... 2years ago I married my wife .. and for various reasons I could not put the petitions ... September 12 of this year I had rietrare in Italy for a serious family problem ... my wife the next day to put the petition 130 .. and after 2 weeks 129f visa k3 .. now days ago I asked for a referral to a lawyer if I could go back in the USA for Christmas .. . the lawyer told me in a very negative way where I announced that I remain a crime in the USA .. I said that I will get more for 10years .. and almost certainly will not give me a visa ....... . now I have 130 that the petition and in the decision-making ... but the 129f petition and also under the immigration decision, but has not cashed the check .... now ..... I wonder what's gonna happen .... guys .. please help me ..... I'm in a panic .... more absolute must have a return for a few weeks .. I left a wife, a family .... a vitaa ... please if anyone knows. answer me .. thank you ...

If I understand correctly, you committed felony in US 10 years ago?

From reading a previous post I think he has a 10 year ban for overstaying on VWP or a tourist visa.

when the visa interview takes place in Italy, expect a denial but be ready to file for a waiver.

It's a dead shame you and your wife not file Adjustment of Status, and get the green card, before you left the USA.

Now that you've been out of status in the USA for 18 months or more, you've incurred an automatic 10 year ban for re-entry (perhaps more than 10 years?)

so.. be patient, follow through with the two petitions and the two visa applications, and get ready for the waiver that must be filed.

If you want to come back to USA, that is.

I called when I left I went to emigration .. I have spoken to no punishment .. I have only said that as a tourist I would not be able to return more .. now I wonder ... we put the petition for a green card .. .... which means apple will??? what should I do??

Please, read carefully what Darnell said. You need CR1 visa since you are married. However, unless they approve the waiver you will not get a visa. This is a long shot but worth trying. Get a good lawyer and file for CR1 petition and for a waiver. You may get it if you are lucky.

Tourist or not tourist ban is for any entry. Currently you do not have a green card. It does not matter. You will not get a visa. Period. You need to apply for CR1 and waiver.

If you already filed, you still need to obtain waiver.

You made a mistake leaving the Country before getting the green card and now you have to wait long time to return to Usa.Usually the CR1 visa will take 10 to 12 months plus a few more months to have your waiver adjudicated,you have to wait at least 1 year and 5months or a bit more to return to Usa.
