salve a tutti ragazzi....sono nuovo in questo blog...spero di trovare le risposte ma sopratutto l aiuto,la forza per superare questo momento frustrantante.....ho incontrato mia moglie nel dicembre 2010 a santa monica..io dopo tre settimane sono rientrato in italia..sono rimansto in italia per cinque mesi..nel maggio del 2011 sono ritornato in california..una settimana dopo ci siamo sposati..sono entrato con un visto turistico..e sono rimasto per 19 mesi illegale nel paese.aspettavamo la sua copia del certificato di cittadinanza..per questo non abbiamo potuto mettere le petizioni 130-485.....nel settembre 2012 per un gravissimo problema famigliare mi ha chiamato a ritornare e sono dovuto ritornare in italia...il giorno dopo la mia partenza mia moglie a messo la petizione 130 e dopo 2 settimane la 129f..per richiedere il visto k3.....fino ad oggi ho entrambi le petizioni che sono in fase di decisioni...quando ho lasciato los angeles..l emigrazione mi ha confermato che dovevo solo aspettare solo 4-6 settimane...e tutto si sarebbe risolto...solo quando sono arrivato in italia...ho realmente capito...che non sarebbe stato cosi..................ho lasciato una moglie..una famiglia...una vitaa....come faccio a tornare a casa????per come ho capito qua sene parla per la primavera......mi faccio una domanda...se prendo l aereo..e faccio un biglietto andata e ritorno...e quando arrivo hai controlli mostro tutti i miei documenti...certificati..petizioni in corso....dimostro la realta dei fatti....mi faranno entrare???...e se entro dal messico?..o dal canada...cambia qualcosa......................ragazzi se qualcuno sa..ho e passato per questa situazione per favore mi risponda...grazie di cuore.....corrado costanzo modena11-11-12

Sorry, you're going to have to repeat your question in English. It sounds like you should have adjusted status while you were in the US but, instead, you overstayed and left the country, and now you have a 10 year bar. Your wife will need to submit a waiver for this.

If you can repeat your question in English I will merge or close this thread. If you aren't able to ask your questions in English I will move this thread to the European regional forum and hopefully someone who speaks Italian and has the answers to your questions will see it.

Hi, as said by others try to translate it in English so it's easier for everyone to understand and you'll get much more answers that way. Don't worry about your grammar, just make the things clear and easy to understand for those who don't speak Italian.

Anyways I was in your same situation but I stayed only 8 months then came back to Italy and we sent the I130 in June. Unfortunately I am not sure they told you the truth about the waiting time being only 4-6 weeks. Usually for and I130 for a spouse of a US citizen it takes about 5 months to approve the petition which means that all the paperwork you sent gets processed during that time and then when they think everything is okay, the whole thing moves to the consulate in Italy. At that point you'll have to pay taxes and have some medical exams and it takes a 3-4 week to get a date for the interview. The interview is to approve your visa and you'll need to prove that your relationship is real. Unfortunately it is a very long process, tiring and consuming so it is true that you might be able to go back home only around spring (if things go smoothly).

I was thinking to do the same, try to enter in the states showing that I have a round trip ticket and that I have applied for a Green Card, even though it sounds like a perfect plan to me, we might not be allowed to do that. Since you overstayed you might not be able to set foot out of the airport and you'll risk to get sent back in Italy and lose a whole lot of money. I know how you feel, I really do. I left my husband there not knowing when I can be back home, I missed our first anniversary, I'm gonna miss thanksgiving and probably Christmas and my birthday.

I think the best thing for you to do is to stay in Italy while waiting for all the paperwork to get processed. If you can afford a ticket make your wife come to Italy for a little vacation.

I am so deeply sorry we all understand how you feel. Too bad this kind of things takes too long but it is so worth waiting. Do not mess with immigration anymore because the littlest thing might delay the whole process or in the worse case scenario you might get banned.

Whoever has more experience and knowledge than me is welcome to correct me if I am wrong and help this friend out.

Can you explain more about " In paese.aspettavamo HIS copy of the Certificate of Citizenship for" are you saying you used someone elses citizenship certificate and pretended you were a US citizen?

You cannot use the visa waiver program or a tourist visa at this point to enter the USA, as you overstayed. You will need to wait out the process abroad, as Krikit said. She can visit you though.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Hi guys ... I'm married to an American citizen ... I have lived for the past 19 months in california .... then a family illness and I had to return to Italy ... now I'm waiting for both petitions to be confirmed. .. are still on the high seas ... I returned September 12, 2012 .. my wife days after my departure to put the petition 130 .. and two weeks after the petition 129f .. k3 visa ... and .... 2 months that I am here in Italy ... even if I'm Italian this country do not feel my ... more since I have a wife, a family legacy ... a vitaa experiences ..... of life ..... someone could point me to what kind of documents do I call the U.S. consulate with me .... I have a copy of the marriage certificate of my wife's passport, copy of your id .. certificate of marriage registration in califonia my and his birth certificate course copies of the originals ........ 30 days ago I printed photographs to show our union ... Christmas photo, photos with family photos .. that reflect my life in America. ....... now I wonder what I chiedereanno in most of these materials I listed?? since I have plenty of time to develop this material .... guys how can I do that earlier ... that God will aid .. corrado and yesenia costanzo

Are you asking how to prove your relationship? It's easy and since you're married and lived with your wife for a long time you have tons of proof to show. Mostly pictures together saying the date on the back (you can write that with a pen) and if you have holidays cards that your or her family sent to you both that's great evidence too

I have both the 130 and 129f petition .. (seen k3) that are in the process of decision ... I never thought that I waited all this time ...... I returned to Italy in September 12, 2012 ... based on the responses that I have confirmed the emigration of los angeles I should take from 4-6 weeks since I'd touch on Italian soil .... but so has not been and will never be so ... because my petitions still on the high seas .... now I ask you ... I have a return ticket and that for December 6, 2012 ... I have to change my flight ritronno ... based on what I read I should have seen after March .... god willing ..... I confirmed these dates?? I move my return in May .....? ... when do you think I'll have my visa in hand? What do you recommend .. tickets cost changes have tickets ... well .... please if anyone knows .... answer me ..... that God protect you ... corrado and yesenia costanzo

I was under the impression that you can only file one petition, i.e. either the 130 or the 129f?! I would check up on that if I were you! Checking on USCIS' website, it says the current waiting time is about five months from the time they receive the petition. Wait to change your flight till the last possible minute because you never know when your petition will be approved, that way you don't have to pay too much by changing your flight several times.

Hope you receive an approved petition soon!

I think I understand what you are saying you want to know how long this will take.

You filed I-130 and I-129F. Well Petitions at USCIS service centers (whether VSC or CSC) is taking quite some time like 5 to 9 months. Once approved from USCIS you will be sent to NVC where more than likely the 129F petition will be administratively closed and the I-130 will proceed. About 4 to 6 weeks at NVC to process all your paperwork than you wait in the interview queue for your country which can be another 1 to 3 months wait. Expect anywhere from 8 to 12 months to complete the process.

What about children? Can you explain please.

I wrote to my wife to do an exception! .... and what this exception?! .... I am very ignorant of the matter ...... ragazziche happens .... how do I get home??? thing and this exception ? because they told me that I would not be punished ... and now I speak of this exception ..... guys ... help me .................... I'm waiting for the decision of the petition ... 130 and 129f (since k3) ...... what do I do ... how should I move ...?? ... if anyone knows please tell me .. . thank you ...
