hello./father is GC holder an mother will deliver baby before getting visa of 6 month that will be transfered to green card also after entering us.

1-what will be the process in this situation ?

2-what forms should mother submit to nvc /she is already filled i864 form and his case was completed PD 17 JANUARY 2011?

3-how much time take for nvc to acept forms of new born ?

When to call or write

The NVC cannot accurately predict the date for a visa interview appointment. Please call or write to the NVC, if the circumstances affecting your application change. For example:

Change of address

Change of marital status

Death of petitioner

Birth or adoption of additional children

Documents you will need is the baby's birth certificate and passport.

Inform NVC as soon as possible after the baby's birth so they could add the baby as your derivative in your petition.

There's no exact time frame for all this because it would depend on how quick you can acquire your baby's BC and passport, depending on how fast things are processed in YOUR country.

Once your baby is added on your petition, the petitioner will have to pay the baby's immigrant visa fee and the baby would need his/her own DS-230 (with visa pictures, Birth Certificate, copy of passport bio page).

I am not quite sure about the Affidavit of Support forms, but might as well tell your husband to prepare a new one and make sure that his income is sufficient to sponsor a 3-member household (him, you, baby). Anyway, NVC will inform you of everything that you will need to submit once you inform them of your new baby.

Once your PD is current and you receive an Interview Letter from NVC, you and your baby will undergo the required medical exam and the baby should be present with you on the embassy interview.

1-what will be the statut of new born in us,he will get green card automaticaly like his mother ?

The baby will be a Legal Permanent Resident, same as you. The baby will receive his/her own 10-year green card.

2-when can baby get citizen?

When you (the mother) become a US citizen, the baby can become a US citizen too.
