i864 and tax year

Hello, I have another question about the I864. I have filled it out now and am waiting for NOA2. I filled it out with 2012 as the most recent tax year. If I get sent to NVC and AOS is requested after Jan 1 (which is likely, since my priority date is only one month ago) do I need to redo it with 2012 as the most recent tax year? Or is there some leeway? I am worried because I live abroad and it could really take some time for me to get all the forms from my employers and get my tax returns filed and then a transcript... all from abroad. I'm worried that could really hold us up...

The most recent tax year is 2011.

The 2012 tax year has not ended. DHS & State Dept. does not expect you to have your 2012 tax return until April 2013.

This is correct, but for the actual interview, it is best to bring both the 2012 tax return and evidence of current income. If self, employed, the 2012 tax return IS the evidence of current income. For an employed person, a current pay stub and/or employment letter is evidence of current income. Don't confuse past with current.

So in the scenario where the interview happens in January or something, you would bring the I-864 filled as 2011 being the most recent tax year along with the corresponding tax transcript, then you would show up with proof of current income. Would you also have to bring the 1040 you intend to submit for 2012 or something too, or is it ok because you may not have all of the information for 2012 yet (like w-2, retirement deposit/award record statement, etc.)?

Hi Georgia Peach. I see we have the same priority date, but you were sent to Texas and I was sent to the NBC. It will be interesting to see what the timelines are!

What makes you think Georgia Peach's case was sent to Texas?
