Hello

I'm trying to fill out our I864 however question 25 says

I have filed a federal tax return for each of the three most recent tax years...

My wife has only filed for last year as the previous years she was a student and not employed during this time.

What's the right thing to do here?

Check the IRS rules on income and filing. Best idea is see a tax professional and file a short form and of not needed provide a statement from them.

Don't check that box ( because she hasn't filed three years).

In the blanks

Don't check last box.

Then add a statement to the end of the I-864--

I was not required to file a tax return in 2010 because I was a full time student and earned $1234.56 in 2010.

I was not required to file a tax return in 2009 because I was a full time student and earned $0.00 in 2009.

Perfectly acceptable to not have a tax return if she was not required to file based on low income. But she must give a statement of why she did not file?
