Hi Folks-

My fiance and I are 4.5 months into the I-129F process. We are hoping it would be approved in the next 4-6 weeks.

Meanwhile, we are trying to decide if my fiance should bring her 9 year old daughter along with her or get her down after 3-6 months after my fiance arriving in the US. We prefer the delay, as that would allow my fiance to do the things required to settle down like buying a car, finding a job, doing all the required paperwork etc, so that we would not have to worry about the child at the same time.

Question- I understand the daughter can apply for a K2, but what is the process. Is it as simple as her going to the embassy and applying for an instant K2 visa or does it involve a lengthy process like the K1? And how long does it take if it's a lengthy process.

if you wanted the daughter to move at the same time should really have applies for the k2 the same time as the k1, from whati understand it takes about the same amount of time.....

Please do more reading on this subject. Last I read is that if she doesn't travel with your fiance you will have to file a I130 petition (for stepdaughter) after you guys get married. I dont think the K2 will be available one your fiance comes on a K1.

You list her on the DS-156K as a child To Follow. She will have one year from the K-1 issuance to have a K-2 issued.

Is it as simple as her going to the embassy and applying for an instant K2 visa or does it involve a lengthy process like the K1? And how long does it take if it's a lengthy process.

When it is time (prior to the one year of the K-1) you merely contact the Embassy (email or phone) and request a K-2 interview date to be scheduled. She must go for her medical and then she goes to her interview with her passport, BC and translations and probably copies of her mother's K-1 (I-94) and most likely another 134 form....not sure about that one, ask the Embassy).

Then she will be issued her K-2 in her passport within about 7 business days of a successful interview.

Baron- many thanks for the answer.

My step daughter is 9 years old, hence I assume the process is the same, in that she being a child, still does not require that her Mom accompany her since her Mom would be in the US?

The daughter would be accompanied by her guardian (aunt) to the embassy.

What Baron said, also might want to get information on the AOS timeline, it takes time to get work papers.

Could you elaborate on this please. AOS for for K1?
