can i file I-130

By citizen in K-3 Spouse Visa Process & Procedures

Hi all..did some search regds this problem..could find some answers, but again wanted to ask seniors .

am legal perm resident..was told at naturalization proccess that i shall have a oath in Sept' 06

but dont know what happened..it never happened..just got confirmed news that oath is scheduled in 1st week of Dec 06..

my que is 1)can i go ahead n apply I-130, get NOA1 and file I-129F the very day i get my citizenship certificate

and then latter upgrade my I-130 ?

2) if doing so shall there be any probs on the I-130 side ?

3) will the NOA1 of I-130 filed by a GC be sufficient for filing a I-129F ???

am also trying to hire a immi lawyer from the AILA..but really wanted to talk to u all first... :thumbs:

10/27/2006 - Case received at CSC

11/09/2006 - E-mail recevied from CRIS saying AOS Approved and welcome notice mailed.

11/14/2006 - An approval letter mailed.

11/15/2006 - Green Card Received !!

That's exactly what I did. The only problem I've had (so far) is that it took them a month to upgrade the I130, but now they seem to be active on it. Maybe someone who's made it the entire way through the process will be able to share more.

12/06/06 - Approved!- - - 12/08/06 - Touch---01/25/07 - Touch

I130 at NVC

12/14/06 - case number assigned

12/25/06 - DS3032 & AOS Fee Bill Mailed (phone system updated 12/27)

12/27/06 - emailed choice of agent; 12/29/06 - received email from NVC confirming choice of agent!

01/01/07 - NVC generated IV Fee Bill (postmarked 1/17 though!)

01/03/07 - returned AoS Fee Bill via Priority Mail (James' shortcut)

01/15/07 - NVC generated AOS package

01/22/07 - received IV Fee Bill - overnighted back to NVC same day

01/27/07 - recieved I864 package; 01/29/07 - overnighted I864 to NVC

01/29/07 - DS230 generated (phone system not updated, email response 2/5/07)

02/05/07 - mailed DS-230 to NVC via express mail

02/20/07 - CASE COMPLETE!!

04/18/07 - INTERVIEW!!!! - APPROVED!!!!

and tanx to u riblet..and noticing from ur signature timeline..u did exactly the way i am gonna do now..i.e. filing the I-130, get NOA1, becoming a USC and file a I-129F..
