I`ve noticed alot of people who are sending AoS are giving alot of informations like:

Copy of life insurance with Alien spouse as Primary Beneficiary

ii. Copy of our health insurance cards

iii. Copy of Car Insurance

iv. Copy of Federal 1040 filed jointly

v. Copy of our joint bank account with statement of account for February 18, 2012- March 19, 2012

vi. Copy of our 2 credit cards

vii. Copy of our Phone Bill

etc..etc..etcc

Soo i am wondering since i dont have almost none of these documents cos i live with my wife for not more than 2 weeks together can we file all these documents at some point later on ?

I am asking this cos it`s absolutely NOT POSSIBLE to have them RIGHT NOW after only a 2 weeks of marriage and togethers life ...

Hey Shuki:

If you don't have these, I would wait for the AOS. Seriously..while they don't expect a lot from newly weds, it is also looking really fishy in the INS (USCIS) eye that you file AOS basically two weeks after you are married...it is better if you guys get some stuff together...such as bank account is a biggie and now that you're married with your wife you guys could do it. Have some time, save some money on it, have some activity on that account is always a good one. Do you guys live in an apartment? Could you guys change the lease so that is on both of your names? You definitely need to have some stuff for the package. Until the interview you can still accumulate more, but if you just send the forms in without any "evidence of bona fide marriage" they will frown and might not going to like...

Well i got your point and it indeed seems fishy but why am i asking you this?! I met some people a while ago who literaly filled AOS few days after they got married without any proof of life together nor bona fide mariagee. Their interview was shceduled aprox in a year after they filled AOS package and till then they had bunch of documents they actually lacked when they send AOS... Also i am not in a rush for AOS but i am for work authorisation atleast temporary... Can i file only I-765 form for temporary work card ?

Hey Shuki: I am surprised to here someone doing an AOS and getting an interview date a year later....that is very unusual. Or at least the people I'v seen here turning around go from three months, to maximum five months. And each one of them sent in some proofs with the package and didn't send just the forms itself. I also sent in....so I was just giving you the advice what I've noticed others did, as well as I did. I am not sure if you would get I-765 granted...I don't know for sure of course, but if you came on a J1 visa and not working under the person who sponsored your J1 visa, you will have a hard time obtaining a work authorization document since J1 should be a non-immigrant visa that allows you to work for whomever sponsored your J1 one visa, and you would have to find a new place that says they will provide you with a new J1 visa. If you are on B visa, that is supposed to be a visa where people "don't want to" work at all. So again, hard to convince INS to give you a work permit. And obviously, if you are illegal you cannot obtain any work authorization as you cannot just stay in the US and work like an average US citizen, or a lawful permanent resident, or like other people who have a valid visa and work under the valid employer. So I am really skeptic that you would get your EAD granted just by itself. But count me wrong, and maybe someone will chirp in and tell you that you can do it. I am honestly not sure.

It will NOT look fishy to file 2 weeks after a wedding! Why on earth would anyone think that? Send what you have and relax. You will have time to gather evidence by the time of your interview. There is absolutely no reason to wait.

It seems like they have Nothing, but if you only need one thing, send the marriage certificat.

You have to send supporting documents!!!

Did you guys live together before you got married? Do you have anything that can proof that you guys have a real marriage? Anything?

How long have you known each other?

Sorry for late reply was away for thanksgiving :) We started living together not so long before we got married but we know each other for 2 years. We do have weding cert, joint bank account, and gonna get phone bills soon aswell. It`s simply not possible to have all documents that i`ve mentioned in first post so fast.

Well i might overexagareted abit, maybe not a year a but around 9-10 months for sure. My J1 program is done and i`ve asked for B2 just for the sake of traveling cos my J1 program was sort of disaster, without free days or time to actually visit any of the cities on East coast at that time so i asked for extension and change of status all together till my flight back. That was back in late august(early september) and we got married a month ago. I am not thinking to get approved for work permit on J1 as that visa expired allrdy and it`s not really possible to get it while on J1 program. I was rather thinking to apply for AoS while i am waiting responce for B2 as i am curently unemployed and in need of a job. We are expecting a baby aswell soo ye i am not really in a situation where i can wait.

Anyhow thx for your advice, appreciate it ;)

I thought so aswell but i was abit sceptical. Will try to gather as much as possible as file AoS as soon as possible.
