Note about including the Beneficiery's BC or Passport

I just wanted to note that I got an NOA2 WITHOUT including Craig's birth certificate OR passport.

BUT, that being said, I would highly, highly, highly recommend you include one or the other. I had many many many worry filled days thinking that I would FOR SURE be getting an RFE just because I didn't include it. It doesn't mention it in the guides, but I think this is one of the few pieces that the guides left out as important to include (even though not mentioned in the I-129f instructions).

My opinion, and I'm sure quite a few here agree. :yes:

I got an RFE for that. (By the way, congrats on the NOA2!!!)

The important thing to remember is that if you're going to send in your fiance's birth certificate, include a translation where necessary. Otherwise you will definitely receive an RFE.

We got our NOA2 also without submitting Fernanda's Birth certificate. We did not receive an RFE. As I recall, these items are not requested by USCIS as part of the I-129F filing process. They want the US citizen's birth certificate. But as we all know, USCIS can ask for them if they so choose. In my opinion, I wouldn't send it unless it was requested. Like Alex+R said, if you submit additional docs tio USCIS that are not in English, they'd need to be translated.

I-751 - Remove Conditions

July 11, 2009 - Certified Mail to VSC I-751 Package

July 14, 2009 - Check cleared bank

July 20, 2009 - NOA1 & 1 yr extension - Receipt date is July 14. Case# assigned

Sept 1, 2009 - Biometrics completed

Nov 25, 2009 - I-751 is approved. No Interview.

Dec 14, 2009 - 10yr Green Card arrived !

I sent in my birth certificate as indicated by the requirements and was never asked for my fiance's birth certificate.

Yes, of course I did. They sometimes send an RFE for the beneficiary's if, for example, they need to confirm his/her identity. That is what assumed happened in this case. They have their reasons, and it does not hurt to send it. The RFEs for this are increasing, and it's been suggested by some VJ veterans that people send in the beneficiary's BC with the I-129F.

I didn't include my (beneficiary's) Birth Cert. and didn't recieve an RFE, but like Cass I'd recommend it as well, if nothing else to avoid the stress that may come with worrying about whether or not you *should've* included it.

I totally agree, however there were a few posts that I came across a while back where the OP talked about getting an RFE for the original petitioner's birth certificate. I was confused as to why they didn't send it in, in the first place.

But yup, I don't think it hurts to send more info... but there's no need for too much extra stuff (the adjudicating officer has to dig through all of it)...

We didn't include mine in the application, but I was required to bring the original with me to the interview. My husband (then fiance) included his to prove his US citizenship. We had no RFEs.

We included the BC with translation because she had just had it done in preperation for the interview in the future. She asked and paid for an extra certified copy with translation. sent that to me, and I submitted with the I-129f. YES, it is not a requirment, but why not if you have it. Especialy since we are seeing more requests "Again" for this doc.
