Hi

I am a k3 visa so i come to the us since 12/27/2009 then i stayed two years with my visa and i applied for the Green Card January 2012 so this January i will have it for one year since i got it also my Green Card is for ten years and i been married for four years now because i married my wife In Egypt a year before i come here ,i am confused really because someone told me that i can apply for the citizenship this January because they count the time since i am here and married with my wife , others says no you need to wait two more years since you got your green card does not matter how long you here and married .. so what is the true on here please .. please let me know when i can start the process for that so i can make my budget to pay the fee for that .

you were married to a us citizen before you migrated in 2009. That means you became eligible to apply for citizenship 3 years after that if you are still married to the same person. You do not need to wait anymore. Go file the paperwork.

Petitioner LPR upgraded to USC June 22, 2012
August 22, 2012: case complete
October 18, 2012: Interview (APPROVED)
October 26, 2012: Picked up visa from DHL (delay caused by Sandy)
December 15, 2012: POE Atlanta....................became USC July 2016!!!!

Mothers' Journey (My sister is the petitioner)

September 10, 2013: Sent I-130 (UPS next day service)

September 12, 2013: Received text to confirm delivery

September 16, 2013: Received NOA 1

March 22, 2014: Received NOA 2

April 8, 2014: File Received by NVC

May 26, 2015: Interview (approved)..........now LPR (delays caused by 2 RFE)

it's my understanding 'the dates' are tied to first issuance date on the first green card.

What is the "resident since" date printed on your green card? That is the date you became a permanent resident and when your clock started. Add three years minus 90 days to that date. The result is the date you will become eligible.

Say for example you got your green card on 12/27/2009, this is just an example okay? I don't know your real date on your green card. After 3 years, that means on 12/27/2012 you can apply for citizenship. However the USCIS gave you a 90 days period that you can apply before that date so you can apply for citizenship on 9/28/2012. Now change your dates with your green card date and you will find out when you need to apply. You have to establish 3 years of residency in US, and during those 3 years you have to be married to the same US citizen you got your green card from. I hope I didn't confuse you. USCIS doesn't go by when you got married, they go by when they gave you the green card. Good luck

Since you are egyptian I will explain it to you in arabic: Lazim tikadim al jinsia 3 sanawat bad matekhod green card. mouch bad 3 sanawat mil gawaz, la. 3 sanawt mil green card.

I will translate this in english so everybody knows what I'm talking about:

You have to apply for citizenship 3 years after you got the green card. not three years from getting married , no. 3 years from the green card.

This is the rule simplified - only look at the 3 years before you file. Years before that time period dose not matter.

On the day you file for US citizenship based on marriage to a US citizen, you MUST 1) have a green card for 3 years, AND 2) be married to a US citizen for 3 years, AND 3) be living with that US citizen spouse for 3 years.

You MUST meet all three conditions when you file. You cannot file for US citizenship if one or more of those conditions have not been met.

You have not had your green card for 3 years, so you cannot file for US citizenship. You do not meet of the three conditions above.

(Of course to confuse matters, you can actually file 90 days early based on the 3 years requirements.)
