I'm sorry to read the events that took place within the last 48 hours. Intent to immigrate is always something that DHS looks out for. I hope your surgery goes well and that the lump is benign. I agree with the majority...file a CR1 when possible and gather all of the facts as others suggested. Good luck.

If U read it properly seem to be a typo, the man got here was detained and deported back home, they figured he had immigrant intent this time because he stayed so long the last time, seemed he had no jobs or biz in Eygypt and had

gone back to tie up loose ends and stay here taking care of wife and kids during and after surgery, language barrier may have played a small role , but OP get a good atty and let him deal with it, there's no real proof he intended to stay unles he was bringing a few trunks or admit to that....best wishes

so sorry you will have to go through your surgery alone. The Customs officer seemed to think he would not return to Egypt although he had his round trip ticket. File the I130 as soon as you can.

I leant watching this program on discovery channel "to catch smuggler" where non immigrants are questioned randomly.they use your words to nail you. And better be a good reason why you embark on the journey.the immigration use his story and yours couple with his previous trip that lasted 4 months to deport him.depend on what your husband told them before he got his tourist visa.you don't stay more than 1-2 months if you don't have any business to conduct here.and that shows you really don't have strong tie to your home country.having you coming to be with your wife doesn't help with B1-B2 visa because everything look like intent.i don't see any options available now other than to petition for him and hopefully they wouldn't use what transpired against his case.America or any country reserve the right wether to admit foreign Allen into their country with visa or no visa. please, go ahead and take care of the lump first.it is well with you.

While understandbly very difficult for you given your situation, it is not surprising he was refused given how long he stayed in the USA during his prior visit and how long you say he planned to stay on this visit. Yes, you can technically stay for 6 months at each entry, but anyone staying months at a time is reasonably going to be suspected of no longer being a visitor but of being an intending immigrant.

When I first read your story, I was wondering if it was in detroit, and I found it was in Detroit. That makes sense. I've been through this and I know the pain. They treated me exactly the same as how they did to your husband. No dignity. They laughed at you, they searched everything, went through my credit cards one by one, counted my money one by one, took everything they can find. They questioned me more than 5 hours and sent me back. Before this, I've been to US many times, POE at New York, New Jersey, Chicago, LA etc, never had experience like this. When I was using my B1/B2, every time I received 6 month stay on my I-94. I had no idea about US immigration law and I presumed that for tourist, you get 6 month every time you enter US. So when I landed in Detroit, the officer said he would give me 45 days this time and ASKED me if it was enough time? I had no idea that he actually digged a hole, I just honestly replied that "isn't is 6 month? everytime I came to US, the other officers gave me 6 month", he then followed his question"so you want to stay here for 6 month?", I said"no, I don't need that much time, I just think you will give me 6 month", he sent me to secondary. And the nightmare happened. I don't want to recall, but they did treat you like a criminal. They don't have consistent rules, if you have a "mercy" officer, he may allow you to call your employer, your friend etc. Other officers may not. The one who interviewed me, he first allowed me to make a call, then a guy looked like his supervisor refused me to do so.

Anyway, I was escorted by another officer to the plane, it was also Delta. This officer told me they actually have quota--how many people should be sent back everyday. I like this country, I think it stands for freedom, for rights, for your voice to be heard. But as an alien, we have nothing. No respect.

Even if she file for a spousal visa...they will have issues regarding "immigration intent". I don't think it was intention but it happened so now when USCIS investigate and ask questions this will come up. Before filing for spousal visa....you must find out the truth of what happened and compile documentation of your findings.

It is important that you keep a paper trail because it is imperative for future references. It is obvious that he overstayed his welcome in the AGENT'S eye. CBP is trained to look for things that is out of sort and they have records of EVERYTHING that is why it is important to cover your tracks until your immigration process is over!

A friend of mine was denied entry because of suspicions. She had to start all over to get it right and she was able to enter. It took her a long time but she made it. She didn't cover her tracks and she paid dearly for it.

Three months is a long time for a visitor to stay in a country and to many professionals that is a red flag. America has over a million illegal immigrants and they are cracking down hard...unfortunately your husband got cracked. I know it wasn't intentional but they do not see it like that.

I am surprised you guys didn't filed for spousal visa in those five months he was in USA. Immigration is difficult and we must cover our tracks if our intentions are good.

I forgot this...a normal visitor do not travel with volumes of personal documentations...RED FLAG. He is a visitor with personal effects...that is immigration intent. CBP search luggages for signs of intent and they may have found many signs. If you are going to stay for five or six months...you are basically moving to a different place. You will take pretty much everything you have in your closet and drawers.....RED FLAG.

There aren't any issues for "immigrant intent" with a spousal visa. A spousal visa IS for immigrant intent, so being denied entry for immigrant intent does NOT affect you.

The only issue here right now is what that piece of paper says.
