I601 Waiver help on extreme hardship

Hi,

Could anyone provide me with some advise on what to provide as extreme hardship on the I-601 Waiver? I'm new to the forum.

During my husband's IR-Cr1 visa interview, he was told that an I601 waiver needed to be filled for the 212 misrepresentation, where he previously filled with the US Embassy in Nigeria with a different date of birth over 5 years ago (before we had met each other and gotten married).

As a wife here in the US, currently without my husband for almost 2 years, I would like direction on what is needed to prove extreme hardship in order to get the waiver approved.

Greatly appreciative for advise, suggestions and comments. Thanks in advance.

Do not attempt this without a lawyer, you also might want to go over to immigrate2us.net for help as they specialize in waivers for foreign spouses

Did they specifically tell you that you can file the waiver?

Are you certain you also need the I212?

Hi,

Why are you calling it the 212 misrepresentation ?

Consulate Received : July 30,2014 Transfer to right embassy complete.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Thank you. I had not seen the sticky...still navigating my way through this new process. Hopefully we'll get as much information as possible along with the lawyer and God's favor all will work out to His glory.

They did say that the I601 waiver was needed and did not mention an I212 when I went to inquire at the Lagos Embassy. Both my husband and I got the same information, so I pray it is correct.

Hi,

I'm assuming the misrepresentation is from the previous filing with a different date of birth. I will also check out the advised website. Hopefully it will be helpful in preparing for this waiver.

You had mentioned both, the 212 and 601 in your previous post so I wanted to clarify that it is the 601. The other one is for inside the US, your beneficiary is in Nigeria so the 601 applies.
