Good day Everyone, Im a Filipina and got married to my US husband last September. We filed the spouse Visa last week and our lawyer advise us that it will take 8 months.

And as newly weds its dilemma for us. Can I apply for B2 VISA while waiting for K3 visa?

and will it affect my petition ? Please help me i badly need advice

Did you file the I-130 for a CR1/IR1 spousal visa?

I'm not going to pretend to know anything about the K3 visa other than it's no longer processed, but I'm hoping answering all of these questions will help someone else help you better.

You can file for anything, will it be approved that is a question no one can answer, but the CO at the embassy.

Read up on the topic titled tourist visas.

No one couple feels any less pain than another through this visa journey, through all the years since documentaion at Ellise island, seperation and immigration to the US have manged to survive and families and couples all seems to meet at the end of the journey.

If you can overcome the ‘Evidence of Ties’ compelling reasons to return to the Philippines,"Every alien shall be presumed to be an immigrant until he establishes to the satisfaction of the officer, at the time of the application for a visa... that he is entitled to nonimmigrant status..." With filing your K-3 a B2 puts you in somewhat of a intent to immigrate.

You can apply for a B2 visa and it will not hurt your spouse visa process. Expect your application to be denied due to immigrant intent.

I suspect your spouse actually filed an I-130 petition for alien relative. When that petition is approved, you will apply for a CR1 or IR1 visa, which are the currently available spouse visa categories for spouse of US Citizen. K3, is effectively obsolete and has be virtually unavailable since for three years. It stopped saving time six years ago.
