Hi all together,

I'm new to this forum and I'm currently filing for AOS on a family based matter.

Here my questions:

1) Evidence of Bonafide marriage -> Copy of prenuptial agreement

Do I have to include the whole prenup with all the pages? Or can I simply use the signature pages

and the cover?

2) What is that section in the instructions for Form I-130 page 6: If married less than 2 years

Does that only apply if I get approved for "conditional permanent resident status" ?

3) if documents show different lastname or address, would I add a Post-It Note to it to explain?

I think, that's it as of now :-)

1. If you are going to include the prenup, I would include all of it.

2. I am not sure what page 6 is off the top of my head, but you will get a 2-year GC if you have been married less than 2 years. It is "conditional" but only in name - you will have all the same rights and responsibilities as any Legal Permanent Resident. What is different is how you get a new card when it expires (you file for Removal of Conditions with form I-751).

3. If it is married to maiden name, there is no need to explain. The G-325A you will fill out for both people will have all names used and addresses for the past five years.

Why include the prenup? I do not think prenup could prove the bona fide marriage. It is actually a document that protect the pre-marriage property/assets or whatever before you got married. It cannot show the co-mingle of your financial source or prove that you guys live together as a married couple. so I do not think it is very useful to be included in your aos package. We did prenup but we did not include it in our aos package.

09/08/12 NOA1 for 130 and 485 and Biometric appointment for 09/21 (I did not check my mail from Aug30 to Sept8 so I am not sure when exactly I received those....)

09/08/12 Received txt message for RFE on I-485

09/15/12 Received hardcopy RFE letter in mail asking for current EAD card and visa to show legally work in the US

09/18/12 RFE replied via USPS priority

09/20/12 Online status changed to RFE review

09/21/12 Biometric completed

10/11/12 Interview notice received for Nov 13th

11/13/12 interview approved

thanks for all the replies so far!

Ok so I'm NOT going to submit the prenup.

Another question that I have is about Form I-765 ("Application for Employment Authorization"):

No.: 16 (Who may file Form I-765?

I have problems figuring out what to enter here.

I'm currently employed on an E-1 visa category and got recently married.

So what would be the appropriate number to fill in?

And how soon after acceptance and issuing of the PRC can I accept different employment?

Category C9. Once you get your EAD you can change your job. When you get the GC the EAD isn't needed anymore - the GC gives you the right to work and travel by itself.

Wow!

Thaaaanks soo much for all the great answers and the amazing help.

I wouldn't know what to do without all your guys help...

Anyhow, one little questions that I have and then I should have all pieces

of this puzzle together :-D (hopefully).

Form I-864 (Affidavit of Support)

Using the sponsored immigrant's income to meet the income requirements,

how do I proof that the immigrants income will continue from the same source?

I have a work visa with the company I'm working for, is that enough proof?

What if I intend to change my job after receiving "Employment Authorization"?

What proof is needed to show income will continue from same source?
