Good day Everyone, Im a Filipina and got married to my US husband last September. We filed the spouse Visa last week :dance::star: and our lawyer advise us that it will take 8 months.

And as newly weds its dilemma for us. Can I apply for B2 VISA while waiting for K3 visa?

and will it affect my petition ? Please help me i badly need advice

Yes, you can apply, but highly unlikely you will get the B2 visa if you are married to a US citizen.

Thanks for your reply :D and applying B2 visa wont hurt my K3 visa application?

It will not hurt it at all. K-3 is no longer available though, so you should be on the CR-1 spousal visa path.

If your lawyer is telling you to get a K3, get a new lawyer, there is no such thing as the K3 anymore. K1 is what you need.

Yes, fire the lawyer because K3s are obsolete visas (if he recommended it)... but NO K1 is not the option because they are married (K1s are for unmarried people).

If they did, in fact, petitioned for a K3, it will be processed as a CR1

You can attempt to get a B2 but it is unlikely that it will be approved with a USC spouse.

The spousal visa you should have filed for is the CR-1 visa , K-3 is obsolete and K-1 isn't an option as you are married.

Alternatively your husband could look at visiting you, that will probably be easier :)
