Hello All,

I am new to this forum.

I belong to F4 category. i am awaiting my PD to get current as per the visa bulletin. i have few queries.

1. as per the visa bulletin, when i shall expect my PD to become current?

2. what happens after PD becomes current and what is the movement of the case afterwards?

3. I am 24 years old, will i get CSPA?

my details are:

PD: 21 April 2001

Case Approved in 2009

HI dua how r u? hope you fine.

As per currrent VB you can expect interview letter one or 2 months because yoy are too near.

and yeah you are eligible under CSPA law, at the timeof your parents interview 8 years will be minus from your current age.

after interview you can expect visa but its up to YOUR case and principal applicant.

most of the cases Department of states does Administration process for MAN.not for women but a lil bit for women.

Why is CSPA even a factor here? F4 beneficiaries don't age out. Is one of your parents the primary beneficiary?

When you say 'case approved in 2009" what exactly are you referring to? Is that the date on the approval notice for the I-130 petition?

Why is CSPA even a factor here? F4 beneficiaries don't age out. Is one of your parents the primary beneficiary?

When you say 'case approved in 2009" what exactly are you referring to? Is that the date on the approval notice for the I-130 petition?

Hey,

primary applicant is my father and we are the derivates. and yes 2009 is the date when our case has been approved by NVC.

just a quick question, what do you mean by "Beneficiaries dont age out"?

My son is aged out he is 22 years and 3 months,and he is derivative and my husband primary beneficiary of the F4 category :crying:

oh thats sad to hear:(.. but why he's aged out?.. CSPA should apply to this case..can you please share your details?

My PD is March29 2001 and the approval date is May5 2002,he aged out by 2 months,this damn VB moved twice only one week,and this happened

ahaan.. but your PD and approval date has only one year of differnce.. are you sure your case approved in one year? and what was his age at the time of applying and which country do you belong to??

just a quick question, what do you mean by "Beneficiaries dont age out"?

F4 beneficiaries are defined as brothers or sisters of US citizens. There is no specific age limit for F4 beneficiaries, so they don't age out.

However, you have said you are a derivative of an F4 petition. Derivatives are defined as the spouse or minor unmarried children of the primary beneficiary. Derivatives who are defined as "minors" can age out, regardless of the visa category. You said in your first post that you were F4 category, but the reality is that you're a derivative in the F4 category. The distinction between the two is important. F4's don't age out. Derivatives do.

NVC doesn't approve petitions. They receive approved petitions from USCIS. It's not unusual for NVC to notify a beneficiary that they can go ahead and apply for the visa even though it's a few months before the priority date is expected to be current. This doesn't constitute an "approval" of any sort, but simply permission from NVC to go ahead and get started on the visa paperwork.

The date that matters here is the date that the petition was approved by USCIS. The petitioner should have received an I-797C notice from USCIS stating that the petition was approved. The date on that notice is what counts here. Not the date on any notice from NVC. USCIS does have a habit of taking their time on family preference petitions because they know that it will be years before the priority date is current, but 8 years is an unusually long time for the approval of a petition.

Check with the petitioner and find out the exact date that the petition was approved by USCIS. That will determine how much time can be subtracted from your age when your priority date becomes current.

well i looked upon the I-797 notice of action and the date written in 6th November,2009 which is approval notice. right now my age is 24 years, so now you can better calculate it:)

Ok, it really DID take a long time for them to approve your petition. :blush:

I don't know your birthday, so just for the sake of argument I put it directly in the middle of 1988. Assuming your priority date is current on January 1st, 2013, then your calendar age would be 24 years and 6 months, but your CSPA age would 15 years, 11 months, 16 days. In other words, you'd have years left before you'd age out. The only thing that would completely screw this up would be a very BIG retrogression. While a retrogression is possible, it's unlikely it would set the cutoff dates back by more than six years.

I think you're safe. :thumbs:

I don't know your birthday, so just for the sake of argument I put it directly in the middle of 1988. Assuming your priority date is current on January 1st, 2013, then your calendar age would be 24 years and 6 months, but your CSPA age would 15 years, 11 months, 16 days. yes it took a long time for approval:(.. we were kids and now became adults.. haha but sad too:(

yes your assumption was totally right.. thank God by the calculation i am safe=).. so what is your case status? what are you waiting for??

Hey guys can you help me out in doing CSPA calculation for my brother please.. Need your advise

His birth date is 13 April 1984 and he is right now 28 years old. Our pd is 28 April 2001 and approval date is 6 Nov 2009.
