However, the check has been cashed and there is no NOA yet. It's been 10 days and the check has been cashed on the 4th day. Should we be worried?

The address where you sent to should be officially found in the web page. Not so sure if that address is in accordance to where you are located in. Furthermore, if you expect so long for NOA, you'd better recall if you ever put mailing notice application form (forget the form name, sorry for that) together along with your application, it should be fine.

Thanks QingChangBingBang. I am not quite sure if its on the list of addresses where the application should be sent. Call me naive but, we do not recall such mailing notice application form @_@. What should that form be containing?

The mailing address for the I-129F petition is in the I-129F instructions. All petitions are sent to the Dallas lockbox address. As for what will happen, I have no clue really. Since they cashed the check, it might be possible they forward it to the right place, or you lost your fee and will need to start again. Be sure and read through the guides and I-129F instructions to make sure you did not miss anything else important.

hmmm did you follow the guiedelines and yes the amiling address is also included in the 129f instructions and for the noa1 .. u can wait for it just be patient

Usually, they say wait 30 days from initial filing until they'll dig around for it or do anything. So you can't get anything out of USCIS by calling them now.

If you sent a check and it's been cashed, go to your bank (either online or down into your bank) and see if there's an image of the cashed check available. It may show the case number and then you can put that case number into the check case status on USCIS' webpage and follow the petition.

When the check is cashed, odds are it's being rerouted to the right service center. I'd expect a little more time than usual until getting the first notice(NOA1) because you have no way of knowing if it'll be sent to the sorting facility(Dallas) and THEN to Vermont/California, or if they send it directly to the service centers.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

It depends on the State of your petitioner's residence. If he's in California, then it get's sent to the Phoenix Lock Box, and then Phoenix sends it to the California Service Center of the USCIS for further processing. I am sure it's forwarded to the correct USCIS address eventually, but they should let you know in writing of whatever action have been done on your documents.

i figure if you sent the stuff to the wrong place, then the US GOVERNMENT wouldn't have separated just your check from your petition paperwork, cashed the check, and then say "tough ######"

then again, i wonder if our government really is that petty. lol

FYI the name of the form you are thinking of is "Form G-1145, E-Notification of Application/Petition Acceptance"

My bad, K1 Visas are a different animal and submitted to two places in Texas. One for US Postal mail, and the other for Fedex and other special mail. I was referring to CR-1 visas in my previous reply.

There aren't two separate places. One address is a PO Box, the other is a physical address for those who want to send via courier, FedEx, or UPS, i.e. services that require a physical address and not a PO Box. However, they all end up at the Dallas lockbox location.
