Point of clarification on Form G-325A and AOS process

We (my wife, stepson, and myself) had our AOS interview today. Right prior to the interview, we were in the waiting area when our IO gave me a clipboard containing two blank Form G-325A, asking me to fill one out. Of course, I eagerly complied.

After getting home, I reviewed the VJ K-1/K3 visa holders AOS Guide about the people required to fill out a G-325A and submit with their initial AOS packet. This is the text from the guide:

"9. G-325A filled out, signed and dated."

I took that to mean the applicant listed on the Form I-485, the individual that is petitioning to adjust their status to that of a permanent resident of the United States, and not the US Citizen spouse.

However, I might suggest based upon my recent experience that the AOS Guide should be amended to say: A Form G-325A should be filled out, signed and dated by the non-US citizen spouse and the US citizen spouse.

Is this something new, or did I misinterpret the guide?? :unsure: I would like to open this up for forum discussion.

This is really good info. I did NOT have C fill out a G325A for himself, so it's good to know he may have to IF we get an interview.

i did the same as you. I did not fill out G-325A for myself, only for my wife. Looks like i will have to do the same when we get to the interview stage.

It is not required of the USC spouse and I never filled one out. My husband was approved at our interview with no problems. I am not sure why your IO had you fill one out. It is not routine.

I don't know why but a review of our packet was I did one. Too me is does not appear the USC needs one, but we are dealing with the government. My friend filed for AOS and I noticed he completed one for himself so I did the same (he was assisted by an attorney buddy). I did not realize I had done so, maybe that's why they it took 10 months to approve us instead of AB's done "Quickly" in 4 months. Congratulations brother.

I checked my package also, and did not include a G-325a from my US husband. Don't know why they asked you to complete one...

But congrats!!! Enjoy Thanksgiving! :)

No. It's not a requirement. The guide is for requirements. The IO asked you for a document that wasn't required, as is their prerogative.

Thanks for the response. I agree, I couldn't find anywhere where it was a requirement. Since it has been a couple of years since you did your AOS interview, and we did our AOS interview yesterday, I was wondering if this indeed was a new requirement, or just some rogue IO request.

I have to say, our AOS interview may best be described as "murky." I felt that the IO was asking some questions from "left-center field." As we were concluding the hour-long interview, the IO wouldn't tell us whether we were approved, or disapproved. The IO said that he wanted to review our file some more, and would either send us a RFE as necessary, or we would get the approval notice in 10-14 days. :blink: As you can imagine, we were quite disappointed! :unsure: :unsure: When we got home, my cell phone had two SMS text message notifications from USCIS, indicated some activity had occurred. When I checked our account at the USCIS website, the ball indicating "Card/Document Production" was filled in (a promising sign). Today, I got two more SMS text message notifications from USCIS. This time upon checking our USCIS account, the ball indicating "Decision" was filled in. Also, today we got email messages from USCIS indicating that a decision had been made, and in typical government-bureaucratic nonsense jibberish, we were able to "divine" that we passed our interviews and my wife and stepson will be getting their conditional green cards in the usual manner.

I was able to offload some of the eight inches of paperwork that I brought with us for the interview. The IO wanted a bunch of photos from our 3 premarital visits, copies of all pages of all of our passports, and copies of my divorce decrees. I was all too happy to comply with his request. :yes:

If this G325A request was a fluke, good. I just wanted to know if this was a new requirement. :o

this might be the day to call into USCIS, ask for the tracking number on the green card postal mailing..

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Hmm, a long interview and he asked for a lot of other things from you too. I say it was just your IO asking for extras. It wasn't required and just a fluke. However, the fluke was no big deal and you were approved, so CONGRATS! :star:
