You can file for Removal of Conditions 90 days before the 2-year-card expires. You're in that window now.

You need form I-751 and supporting evidence.

2/2-13 is after new years, so anywhere between 90 days prior to that day an closer. Don't let your current greencard expire - your driver's license and work permit follows the validity of the greencard/lawful stay. Submit ROC papers and make sure USCIS has it before your current greencard expires. Personally, I'd prefer having NOA1 in hand before current greencard expires.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

AOS process, December 2011 > July 2012

EAD/AP Approval took 51 days from NOA1 date to email update. (77 days from filing until EAD/AP in hand)

AOS Approval took 206 days from NOA1 date to email update. (231 days from filing until greencard in hand)

From filing I-129F petition until greencard in hand: 655 days

Hi - this is the Uncle - you have until 02/03/2013 to file (the expiration date on your current green card)

so, can you scrape up 590 USD in January, mail it all off on 31 JAN 2013 ?

it's a 90 day WINDOW - you have 90 days in which to file.

Well technically you've had 2 years to save it, but I know how you feel. Mine came around at a really bad time for us.

I suggest you file as soon as you can (get a loan and pay it off in the New Year if that's when you'll have the money), because if you make any mistake in the filing and it's rejected, you will miss the deadline. Not filing in time means your GC status is revoked. You cannot work, you cannot leave (if you want to return). People have filed late and been fine, but others haven't.

Luckily, this is the last "must file by this time" that you will need to worry about.

Also, you MAY get an interview. you will get biometrics. If you have an interview it will be at your local office. Your GC will be mailed to you.

There is no need to be arrogant about it. Some people aren't blessed with perfect lives and sometimes ####### happens and the money has to go elsewhere.

That said, I had to get a loan to pay mine because of some severe financial issues we were having. It needed to be done so we did it. You don't live in others shoes so you can't assume to know what happens to them.

If you want it in earlier, it may be time to tell your family that there won't be Christmas gifts this year. I'm sure they would understand, especially since it's to keep you two together in the country! Gift's aren't worth you missing the deadline, so don't put yourself into debt! I hope you can find the money. :)
