After my fiance and I get married what is her status until we file for her AOS?

Once she files for her AOS, she becomes a legal permanent resident and can work, correct?

I've read that the AOS has to be filed within the 90 days since the K1 is only good for 90 days meaning that you would actually have to get married before the 90 days, say the 89th day to apply for the AOS before the 90th day, is this correct?

Could anyone provide insight into this please?

That's a gray area. She will be non-immigrant married to USC without specific immigration status.

Filing for AOS doesn't change one's status. She will be able to work only after receiving EAD or GC.

You have to marry within 90 days of K1's POE. You may delay filing for AOS if not ready for some reason, but it is not recommended.

You can file for AOS at any time after your marriage. Where did you read you had to apply for AOS within 90 days [source]?

You need to marry within 90 days of entering the US.

Once your wife has LPR she can work , if she files for EAD and gets that before her LPR is approved she can work then!

I believe while your wife waits for her AOS to be approved she is in a "period of authorized stay" and will have no legal status, kind of like limbo?! (I am sure someone who has completed their AOS from a K-1 can confirm that).

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
