Arrived on K1 next step marriage

Hello,

So my fiance from London arrived now my question is... I was told by the courthouse and social security office that she does not need a social security number to get married. So they advised us to get married first so that when she applies for her SSN she will be able to apply with her new last name, which is mine. They said it would save a step. My question is, is this true? Please help...

I would suggest getting it in the maiden name regardless of before or after marriage. Your local government person does not have a clue about immigration hassles. You're going to have to go back after she gets the greencard to change status, so change the name then to the married name on her greencard.

USCIS is telling me to she gets her SSN after marriage and AOS? Also for a K1 am I to applye for I-485 or I-693? In california they are processing I-485 from March 8, 2011... thats over a year and a half...

You can get the SSN before or after marriage, so long as there is at least 2 weeks left before your I-94 expires. It can sometimes be easier to get it before you marry in your maiden name because it will match the name in the system, and some of the SSA workers have no clue about immigration and have told people they cannot get an SSN after marriage and have to wait for the green card. This is not true, but there really are some ignorant office workers out there. You can go back when you get the green card, which you will apply for in your married name, and then update your status with the SSA and change your name on your SS card all at once.

Everyone entering on a K-1 needs to adjust status. Whether or not you had all the required vaccinations at your medical and if your DS-3025 is properly filled out would determine if you need to see a civil surgeon for an I-693. Here is the AOS guide: http://www.visajourney.com/content/k1k3aos

Also, the CSC does not show times for a family based AOS. Those times are for employment based. The CSC is not currently processing family based I-485 applications. Since August, there are no more transfers to the CSC. Your AOS will either be processed at the NBC without interview, or sent to your local USCIS office and you will be sent a letter notifying you of your interview date and time.

don't forget the RM 10211.530 printout mentioned in that article. if the SSN worker turns you away (which they might, they aren't immigration officers) you will have proof from SSA website that K-1 is valid for SS and allowed to work.

i would suggest you get the SSN first. changing her name on the card later is an easy and free process later down the line.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
