Timeline

Hi VJ'ers!

My fiance's father never signed his birth certificate so therefore he has no one listed as his father. However, he does know who his father is and he lives in the USA. When he fills out the K-1 forms and it requires the birth certificates of his parents and give information about both his parents should he do this? His father acknowledges him as his son but has never supported him financially and never changed the birth certificate to reflect his acceptance of parentage. How should he answer these questions?

The k1 petition does not ask for the birth certificates of the beneficiary or petitioner. IMO he should leave the name off of the form. Only because even though he knows he is his father, paternity has not been legally established.

Timeline

Birth certificates of the USC's (beneficiary)parents are not required, only the birth certificate of the USC or other proof he is a USC. The G-325A will be where he lists his parents (you will need to fill one out also). On this form he will either need to list him as his father or put "unknown". This will be up to him, but if no one is listed on his birth certificate, a DNA test would be needed to prove paternity. If he goes by his father's last name, probably best to list him as his father?

Thanks so much... he has his mother's last name , so I will tell him to put "unknown" since paternity was not legally established. So I, the USC, am the only one that needs to present my parent's birth certificates and their marriage licences, correct?

I'm sorry...I forgot to mention that we received our NOA2 and are preparing paperwork for the next step.

You only need to proffer a proof of US citizenship for yourself, for instance, a photo copy your birth certificate, or your US passport, or naturalization certificate.

I'm sorry...I forgot to mention that we received our NOA2 and are preparing paperwork for the next step.

In that case, refer to the embassy or consulate website where your fiancee will be interviewed for the required documents and evidence.
