Hey everyone, I just have a question. I am a US Citizen and my girlfriend is from France, we have been dating for about 2 years now. She is currently here until May on a B-1 Business Visa with her job. I was planning on surprising her around Xmas and Proposing. I was wondering if we were to be married before her 6 Month B-1 is up can I just apply for Adjustment of status? Does she have to return to France at all? Of course this all depends on on if she says Yes!

If she is in US now and you guys get married (if she says yes of course) :yes: . I think you can start with the spouse visa but I think she has to go back to France till she receives the approval. I'm not expert in this kind of visas ( I did the fiancee k1 visa) but I give you some links so you can check and see which option is best for your case. Probably a CR-1, you will have to avoid any fraud issues with the intent in your explanation. see the guide. Here is an article from a law firm that may apply; http://www.thesolomonlawfirm.com/cm/practiceareadescriptions/immigration-articles/intent-when-applying-for-a-visa.asp

Lots of people will suggest that you get married and she go back and wait for a spousal (CR-1) visa and it's not bad advice. If she came here without a plan to immigrate then yes you can get married and file for AOS.

Here is something to think about though, if you do marry and file to adjust she will have to stay in the US until she has her greencard (or AP if you file for it).

Study the guides here and you should find all the answers you are looking for. After you propose and she hopefully accepts you should probably discuss the options with her as well.

Marry and file for AoS if she is fine with not being able to go back to France for 3 - 4 months until she receives her AP; marry and file for a CR-1 immigrant visa if she needs to return to France before then.

If she says yes, and does not have to leave the country for any reason for about 3 months after you file the application, you are fine to AOS. The guide can be found here.
