In the case of extreme cruelty and abuse and you dont have joint ownership of anything or your name is not in the lease, bills, insurance and so on because your ex was controlling and always shows power by doing all this just to subject you to his/her mercy, but you have police reports, pics of vacations, evidence of destroyed properties, letter from counselor and emails of threats can you file a waiver on extreme cruelty?

What part of the process are you talking about here? ROC or AOS?

If you're talking about AOS you'd be filing for VAWA. You need to prove bonafide marriage AND abuse. I think you'd be fine on the abuse side with the police reports and letter from counselor. But I'm not sure about the rest. Did you have anything with the same address (your license for example?).

If you're talking about ROC then you also need to prove bonafide marriage and abuse. Personally I would go the divorce waiver route, not the abuse route. I would use the evidence of abuse as a reason for why you don't have co-mingling evidence. I would try and meet with an attorney (you can get free consultations with most attorneys) to look through what you have. What about jointly filed taxes?

Gyrate1 it seems you are filing ROC, yes you can file a waiver based in extreme cruelty, you must prove abuse and bonafide marriage in Vawa Cases and ROC as well.

You can explain because of his controlling behavior you don't have any bills in your name.Do you have any bill in your name showing the same address of him such as cellphone bill, letters from doctor,dentist,vet etc...?how about joint tax return?
