okay. Well in law, like in life, sometimes things don't wait. I wouldn't wait either. Ask him who in his firm will go in his place. They basically just need to be there to listen. Hopefully it's "just" biometrics, if it's not.. that's when the lawyer could step in, request a formal interview at a date convenient with your proper attorney's schedule (unless the "step-in" attorney also specializes in immigration law).

**Edit - I would liken this to seeing the door to the lions cage open and just standing there seeing what's going to happen, rather than shutting the gate.

Unfortunately my lawyer works byhimslef for himself, other than his assistant. Im hoping its just biometrics , like she said , thank u

Vanessa - I dunno - this is a TPS case, and it's different, aye?

they have a work every saturday because they also called my husband last saturday to informed that they working my petition and after 3 days i got my approval....

*** Thread moved from main AOS/Family-Based forum to "Bringing Family Members of USCs to America" forum -- OP is adjusting status as a result of a USC family member's having filed the I-130. ***

OP, please start future threads in the "Bringing Family Members of USCs to America" forum -- you risk receiving inaccurate answers if people assume that you're adjusting from a family-based visa. With that said, your best bet is a visit to the USCIS office or to set an InfoPass appointment.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Hi Katie,

What kind of phone(android?...) and service(sprint, t-mobile...) you have?

4example, if you have an android: Open up your voicemail. At the top of your screen, touch the header "Voicemail" and let go. You will get a drop down for Inbox, Outbox, Deleted, and SD card. Select Deleted. You will now be in the deleted folder. To get back to your Inbox, touch the header again and select Inbox.

and if you have a sprint service: just got to Google.com/voice and sign in with your gmail address and you'll see all your texts and voice messages

it is worth giving it a try. Good luck!

I do, i immediately called right back, it was a phone number that does not accept incoming calls.it was a 213 local number.

your best bet is to just make an infopass appointment. I have had to make them and it is your safest bet instead of losing sleep and trying to guess and worrying. Good luck

Just wanted to update evryone after all the great amswers i received from my last post saturday. Tday early morning i went over to the LA USCIS field office. The very nice man at the window greeted me, i explained to him my situation that i missed the officers call and i deleted the voicemail,he immiediately called her this is how it went: "Smith theres a young lady here that says you called her saturday morning regarding fingerprints, she deleted the voicemail and wasnt able to call you back and shes worried " after a minute they hung up and he told me to go in her office down the hall that she had mailed me a biometrics appointment but to disregard it she was going to give me one personnaly to get it done today. So i knocked she told me to come in totally unexpected she wasnt the same ''grumpy disorganized" person i met at the interview. She asked me how was i doing how was my weekend, she said she was expecting my call that she was glad i went personnaly so we could speed up the process, and something that shocked me when i asked her if my RFE was ok she said "it was more than enough, i was going to approve you friday as soon as i received but then i realized i didnt have your fingerprints" i was so happy but i asked why did i need to get them done again she said "because theyre only valid for 15 months,i told her i just had them done June! then she said "weve been having problems with the biometrics locarions not doing their jobs" but i strongly believe she mightve lost them. So then she gave me a biometrics appointment for today ,i asked her when can i expect a decision after this she said " well the fingerprints should be back by wednesday and its a holiday so expect my decision within a month!" So i feel good but confused at the same time im so glad it went this smoothly and beat of all i was able to see and talk to her she was ver very nice and cordial (which makes me believe what other people say that IO's get annoyed to have a lawyer present) can anyone share your thoughts on this?

good.gif Good deal! Glad you were able to get this done and that she redeemed herself by being nicer!

Thank You it was totaly unexpected im glad i got a chance to go in her office and speak to her 1 on 1 something im sure rarely happens! She totaly did a complete 180, She was very nice and we even made small talk ,thats why i believe it might be better not to have a lawyer present for the interview,it only seems to annoy the officers, maybe they feel uncomfortable. And the officers at the window are really nice and accomodating too. Both times ive gone there (once to drop off my rfe and today).
