Philippines=recognition of Divorce Decree

Since you are a USC, no need to for you to get an annulment of your previous marriage which was taken in Phil. If you plan to get married again in Phil after your marriage here in US with your fiancee, just bring all the papers or divorce paper you have with your previous marriage in a pinay which is now already a USC.

.... they will ALREADY be married when they return!! Jeez! They don't need to bring any papers except maybe a copy of their marriage license from the states to show the person performing the ceremony in the Phils so he understands.

Totally irrelevant as they are not actually marrying in the Philippines. They will marry in the USA and come back to do a "2nd marriage" later, which is simply renewing vows for the family in the Phils.

It doesn't matter where they get married. If the divorce decree is not recognized in the Philippines they can be found guilty of bigamy upon returning to the Philippines. The OP has said he was once married to a different woman in the Philippines. He wants to know if his divorce is recognized there. Regardless of the renewal of vows issue, if his divorce decree is not recognized by the local courts he will have a pile of trouble awaiting him when he tries to file the new marriage with the NSO if the old one is not dissolved.

The fact is that, in some cases, people that have had recognized marriages (filed with the NSO) and have had trouble getting a divorce degree recognized and therefore are unable to marry a different Filipino citizen.

It is clear that the OP's fiance wants her marriage to be filed with the NSO. If her husband is still married according to the NSO there is going to be a lot of trouble.

This is how I understand it as well. Otherwise, the OP would have two records of marriage to two different women in the NSO without records of divorce. I'd probably contact a lawyer who specializes in family law in Philippines to be sure. A one-time consultation is cheap.

Yeah, he would need to go to Embassy first, and I've heard of people trying to do that. Don't know why people think they can be married in the US and again in the PI,,,,,, :lol:
