My husband and I recently got married. he came here on a B1/B2 visitor visa and his I-94 does not expire for another month. We are planning to file concurrently I-130/I-485/I-765 and I-131. my hiccup is I just started changing my name on my document and haven't changed my name on my passport yet and my tax documents have my maiden name on it. Do I have to wait till i've changed my name on everything to file (i.e. passport, social security number) or can I file with my married name and submit my marriage license with every application? Also for the affidavit of support can I submit it with my married name on the petition although my tax return has my maiden name on it? any advise will be appreciated, especially from those who've been through the process already. Thank you all!

I see that you are filed the same forms for AOS like me [ I am adjusting my status from( former F-1 )than B-2 last one} through marrying US citizen. Would you able to tell me that how many passport photos did you submit with each forms like I-130, I-485, G-325 A, I-765, I-131( advance parole)? I have to file very soon and I am confused how many photos they required for each forms.

Another question is related to I-485A. I know that me (beneficiary) and US spose need to fill out one for each of us. I am keep seeeing people saying that I-485A needs 4 copies. I dont understand why. Where the other two copies needs to be attached? I would also be very happy to see a completed Cover letter for someone whos adjusting ( adjusted )status, from Work, F-1 or Tourist Visa. I am not sure that if you have or had cover letter or most importantly if you would be able to share here. Please let me know if you know the aswere any of my question.Would greatly appreciate...

Bordeaux, you need to read the instructions or each form. It says very clearly how many photos to send.

I-485A is not for you. Maybe you are confused and meaning to ask about something else?

Have you found the VJ guide up top?

Have you fond the "Advanced Search" function for a cover letter?

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

Applicant is the one applying for a greencard. You're a US citizen and therefore can't apply or adjust status and the I485 is an application for adjusting status. Your husband, on the other hand, is eligible to apply for adjustment of status. He is the applicant. He is the one filling out the I485 and his supporting documents needed.

You are eligible to be the sponsor - you submit everything related to the affidavit of support. And you are also eligible to petition your husband. So you fill out the I130 and the supporting documents needed. And then your husband fills out what he needs to. EG., G325A is needed from both of you.

When you submit I130, G325A, I765, I131 and I485 together in one envelope, you treat it like different applications/petitions and submit evidence for each form. If 2 different forms each require 2 sets of pictures, then you'll submit 4 pictures. The same goes for copies of birth certificate, marriage certificate and whichever is needed for each form. You will need to read the instructions for each form to know what supporting evidence is needed.

Please read the guide - it has awesome and precise info. Good luck!

Thank you all for your responses. Just to clear up a little confusion I'm having, will I (the pertitioner) need to submit my marriage license with each application even though some don't ask for it such as the I-485 which my husband (the benificiary) submits and the I-864 as my proof of name change. Also the marriage license which i send in with the petition does it have to be certified copy with the raised seal? Please let me know. Thanks so much.

Some have sent copies of the certified marriage cert. and didn't get RFE'd. I sent certified copies because I didn't wanted to potentially get slowed down.

On page 5 in the I485 instructions, it asks for a copy of marriage certificate. That's your husband's evidence of eligibility.
