Hi All

I am LPR and filed I-130 for my wife on last week of February 2012 and received NOA1 from USCIS on February 24 2012. I-130 is pending on California service center and I have not heard anything from them after I got NOA 1. My Citizenship application(N-400) is also pending. I have heard that if I become citizen before I-130 gets approved then I-130 will be further delayed. Is it true?

Since my citizenship application (N-400) is pending and its not recommended to leave country while N-400 is pending, I am thinking to give a try to apply visiting visa for my wife. By chance if she gets visa and comes here, does it effects her I-130 application processing?

I really appreciate you guys feedback.

Feb 20, 2012: Received NOA 1 ( Priority Date Feb 18, 2012).

July 12, 2013: Requested USCIS to Upgrade petition from F2A to CR1.

July 27, 2013: USCIS sent confirmation email regarding upgrade.

September 11, 2013: NVC Entered AOS Documents into their system for Review ( NVC Says it may take 30 business days to review)

September 16, 2013: IV Bill Invoiced.

September 16, 2013: IV Bill Paid.

September 17, 2013: NVC Accepted IV Bill Payment.

September 19, 2013: Filed DS-260 Online

September 20, 2013: Mailed Civil Documents for IV application

September 23 ,2013 : NVC Entered Civil Documents into their system for Review ( NVC Says it may take 30 business days to review)

When you finish your Naturalization, you can "upgrade" your wife's petition to IR1/CR1. Doing so will speed up her petition.

Your wife can apply for a tourist visa as long as she can prove strong ties to her country. She can show proof that she has a stable and good earning job, properties under her name (car, house, land, condo) and money/bank savings.

Having a tourist visa will not have a negative effect on your petition provided that you don't OVERSTAY and/or WORK ILLEGALLY in the US.

Hi All

What country? Probably doesnt matter because there is almost zero chance of her being granted a tourist visa with a pending petition. She has shown intent to immigrate with the petition so will have no way to PROVE she intends to return to her country.

I really appreciate your feedback, thank you very much for your response.

I don't know whether my wife can get visitor visa or not. This is just a simple try but before trying I just wanted to make sure that this attempt does not give any negative impact on her I-130 petition.

Regarding my citizenship application, it looks like I will be citizen just 3,4 weeks before I-130 application will be touched. I have been told that once I will be citizen, my I-130 application will be taken out from Green card holder's queue and then will be put in citizen's I-130 application queue and I have to wait for next 5, 6 months again for my I-130 to be touched. Is it right or they will start looking at my paper as soon as I will be citizen as I have filed I-130 on February 2012 and its already more than 5 months?
