Hi everybody! I have a question regarding bringing my children (8 and 6 years old) to visit me for Xmas. I have a green card, and am married to a US Citizen. Next year I will be applying for US citizenship. I would like for my kids form 1st marriage (they are mexican and live in mexico city) to come here for Xmas and visit me. They tried to apply for B1/B2 visa, they were denied the visa... What's the best thing to do? they told there mother that they need to show more proof that they are staying in mexico....I have no intention to keep them here in the US since they are at school in Mexico, their mom lives there, her parents live there....So what do you suggest for me to do? Should I wait till I am a citizen, then request them as dependent and give them the citizenship? Even my intention is not to bring him here to live in USA. I just want for them to be able and spend vacation with me and my US citizen wife...

Thanks for the help

Citizenship will take several years of living in the USA, and if they "only" get a greencard they will loose it of only visiting. What proof did you show the first time that they will return after their visit to you?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Their mom showed documents from their school that they are attending classes and that they are living with her and a letter from a Public Notary giving her authorization to take the kids out of mexico just for vacation and at the interview she said she has no intention of letting the kids stay in the USA, that they want just to spend Christmas with me (their father). I don't know what other stronger proof could they give to show that their intention is not to come and live here. I want them to be able and visit for Christmas or Summer...

Your wife can show additional proof that she has legal custody of the children, certificate of employment stating her current income, properties under her name (car, house, land, condo), her bank statements, her income tax return and medical insurance showing the kids are her dependents.

If that still didn't work out, just go visit them in Mexico.

It may be a language issue but you made it sound like your ex also applied for a visa.

Yes, she did too. She's studying dentistry in Mexico, so she has no job, she's a student. She wanted to come with her parents to the US (since the rest of her family has a B1/B2 visa), and they come often to the US for shopping. She used to have a visa that expired like 10 years ago... So, I think the only option I have is to go and visit my kids, thing that I do 2 or 3 times a year. I just wanted for them to come here and take them to Disney Land, and have them come here more often...

With that clarification, have the kids try to re-apply without the mother, and the mother write a letter she wants them back and is only allowing them to visit for 2 weeks (or whatever length of time).

Thank you for the advice. I'll try to do that and wait and see what happens. Thanks!
