Ok so I got a letter today from US Citizenship and Immigration Services called "Request for Initial Evidence" it says they "On form I-864, contract between sponsor and household member the household member needs to submit…" then it lists a lot of things all of them relating to proof of income and wanting IRS returns. Now my question is who is the "household member"? Is it me (the USA citizen) or is it my wife (the one applying). I don’t know why they even care though since we had a joint sponsor who very easily covers the requirements.

Did you submit an I-864 for yourself, or just the joint sponsor?

Someone who knows what's going on will come along soon I hope. :)

Is the joint sponsor a member of your household? Parent?

You are definitely the "sponsor." That I've got.

As you(USC) are the sponsor, you need to fill out the I-864. Your wife can submit a I-864A(household member), if your income does not meet the minimum requirements for a household of 2 -- about $16K/year.

On Edit: Even though you have a joint sponsor to meet the requirements, again, you as the USC must submit a I-864 since you are the sponsor of your wife's visa. Without your I-864, you will not meet the requirements for the affidavit of support.

7/02/07 - Delivered to USCIS in Laguna Niguel,CA

7/07/07 - CSC returns I-751 packet because we used an older I-751 version. Mailed I-751 with latest(02/07) version via Priority Mail with delivery notification

7/09/07 - Deliverd to USCIS

7/10/07 - NOA date

7/12/07 - USCIS cashes check

7/21/07 - NOA received(GC extended for one year)

7/24/07 - Biometrics notice received

8/10/07 - Biometrics appointment in W. LA

8/28/07 - Card production ordered

8/29/07 - Approval notice received online

8/30/07 - Approval notice recieved in mail

9/04/07 - 10 yr GC received in mail

I filled out the I-864 and sent it along with our application but my income does not meet the requirements so I got my parents to be my joint sponser. My parents filled out their I-864 and we sent it in the package along with their IRS stuff and W2.

This just has me totally confused, it sounds like they are talking about my wife but she has never worked int he USA how would she have IRS reccords to send them?

That's incorrect. The immigrant spouse does NOT complete I864A. If they are working and contributing to the household income that gets listed as 'other' on the new form.

It sounds to me like the OP submitted an I864 for himself without his own tax return and that is what they are wanting.

Okay thefish did you submit an I-864 too even though you did not qualify? I know even if you do not qualify you have to submit a copy from yourself.

Yes I did fill out an I-864 myself but I have no IRS records as I am a full time student below the minimum income and my parents claim me as a dependent. I sent in a letter attached to the I-864 explaining all of this (as it says to do on the form if you have never filed a tax return).
