RFE for Intending Immigrant's Birth Certificate

Timeline

I sent birth certificates for my children but not for me. I did exactly as the instructions said so it sure would suck to receive RFE based on that!

I haven't seen any NBC RFE's for the BCs yet, but they only recently started approving petitions.

I'm hoping we'll have no issues too, but just in case we do, I'm going to order my husband's long form soon.

Really. You have seen NBC begin to APPROVE petitions? Do you have an example to point me to?

No, I'm going to go rummaging through the Progress Reports forum but you are welcome to.

I've seen people say their NBC to field office applications sent in August were approved as well as a few september ones starting to surface, supposedly. I haven't seen the september posts myself, just what other people have posted regarding being upset that they are being approved when they have been waiting in vermont since april/may/june.

I never said NVC. I said NBC.

Of course. It's a typo. I suspect the approvals are occurring in the field offices but they have no means to generate the correct approval notices. So, they just notify NBC they have approved the petition and NBC generates the I-797 notice.

As a side note, due to this procedure change, we no really have no firm indication how I-129F petitions for spouse are being handled.

I was speaking of NBC cases specifically.

This one was posted by someone from the VSC and I think the last one I saw was in Cali.

Unless they have been sent to NBC and didn't update their timeline.

I don't think the timeline thingie works with cases transferred to local field offices. I don't consider those as being adjudicated at NBC.

are you saying that you not send in a photocopy of the birth certificate?

I sent in a photocopy of her birth certificate, also a photocopy of my birth certificate, with the I-130 submittal.

The RFE is asking, specifically, for a certified copy of the birth certificate?

fwiw, a certified copy is one that is certified by the issuing authority... and it must be 'the original thing' issued by the issuing authority - so I'm a thinking a photocopy at this stage (RFE asking for certified copy) is not going to work for you.

scan = photocopy, alas.

You have more info on the exact wording of the RFE?

No we did not send in a copy of my birth certificate because it was crossed out in the VJ Guide saying no longer required and it was not listed in the I-130 Instructions either. Both were saying only the Petitioner's BC was required at this time. When he filed I didn't have a long form BC and had luckily ordered one and had it in my possession already. So I sent him a scan.

I had hubby re-read the RFE to me last night. It was asking for a copy of my birth certificate. What had him freaked out was the last page said something about "certified", when he re-read it, it is requiring a Certified Translation for a BC not in English. So mine should be fine because mine is in English.

I will have him scan it when he's back at work next week and send it to me so I can put the exact wording on the thread. He knows I'm ####### when it comes to paperwork, so it won't shock him that I'm asking. :P

Oh no! - I didnt send a Birth Certificate for my husband either. If my permanent address is in South Carolina, but I am currently residing abroad - would my case still go to Charleston. Ughh I hope they are not inept and not knowledgeable about the requirements!
