RFE for Intending Immigrant's Birth Certificate

I have never submitted an original document with any petition or application.

Scan it and email it and he can print it and send it (with a copy of the RFE)

Hubby got an RFE for my Birth Certificate. :(

Both the Guide and the I-130 Instructions are the same and say it's not required but Charleston wants it.

Luckily I had ordered my long form BC to have it ready for future need so I'm good to go there.

Hubby wants to know if a scanned and printed copy is good enough (I really, really do not want to send my only original) and what should he include with the BC? I was thinking he needed to include a copy of the RFE, but does he need a cover letter?

On a happy note, at least it's been looked at. :)

My friends dad got RFE for beneficiary & petitioner BC from NVC Oct and sent them in via atty.

That's from Nvc not from uscis. The i130 does not require the beneficiary bc unlike the Nvc paperwork which does

the intending immgrant's BC used to be required at he USCIS but no more. I guess some field offices are not aware of the recent requirements. Just because they work with immigration does not mean they know every thing but for those who are yet to submit, it does not hurt to include it in case it gets tranferred to a field office. we did not include in ours though.

01/16/2013: IV invoiced &paid. AOS & IV mailed in one package(arrived 01/18).

04/19/2013: Interview; APPROVED!!!!!

Hubby doesn't have a scanner at home so I'm not sure what exactly was asked for as I haven't seen it myself. He told me the RFE was 5 pages.

He was thinking of making an INFOPASS appointment and driving to Charleston to find out if the scanned copy (of my original BC) that I sent him and he printed in colour was good enough. All of the other documents sent were of course just regular copies, including my daughter's BC (for her I-130) which we didn't get an RFE about, so we were thinking that just a copy should be okay.

Getting a copy certified here is not cheap like down south and then mailing it express thing makes it fairly expensive (around half a days pay for me) and I would rather not do it if it's not necessary.

We also didn't send it, because it was not asked for. We did, however, send a copy of the bio page of his (immigrant's) passport. We've just ordered a copy of his birth certificate with English translation for the NVC stage. I hope we didn't mess it up! Our I-129F was approved without his birth certificate as well. :whistle:

Nothing at NVC stage needs English translation as long as it's in the local language where the interview will happen.

USCIS can request anything they want but it could be the folks at the local office are not up to date on the requirements.

Facts are cheap...knowing how to use them is precious...

That is good to know. :thumbs: Many of the Danish documents come in English/Danish/German so it isn't exactly hard to produce them. When they gave us the marriage certificate it was already in multiple languages (Danish, German, English, French, and Spanish!).

I know that Swedish people can read Danish and vice versa, but the Danes interview in Stockholm, not Copenhagen, so it isn't exactly the local language.

If all Danes interview in Sweden, then documents in either Danish or Swedish will be fine.

I am thinking that the Field Offices may be using older manuals or the personnel aren't aware of changes that have been made. They were specific in the RFE that the BC had to include my parents' names so they are looking for more than proof of citizenship.

I hope that the other people sent to Field Offices have better luck and no RFEs.

are you saying that you not send in a photocopy of the birth certificate?

I sent in a photocopy of her birth certificate, also a photocopy of my birth certificate, with the I-130 submittal.

The RFE is asking, specifically, for a certified copy of the birth certificate?

fwiw, a certified copy is one that is certified by the issuing authority... and it must be 'the original thing' issued by the issuing authority - so I'm a thinking a photocopy at this stage (RFE asking for certified copy) is not going to work for you.

scan = photocopy, alas.
