Marriage Based Greencard Process Steps for H-1B holder

Hello Everyone,

I have been looking a lot for some simple procedures to file Marriage Based Green Card. But there is no FIX steps of doing so.

Here is my case,

I am on H-1B- got visa stamp, then changed my job- Initial Status of my H-1B is pending - waiting for approval.

My wife - USC - Left her job after marriage - Primary sponsor

Now, What I'm looking for

List of Forms needs to be filled out

Filing fees

What forms needs to be submitted at once? (Or All forms needs to be sent seperately OR together?)

And once I know the forms, I will go ahead and start filling it out one by one.

-- Once the process is done and I get my GC, I'll write one easy to understand document for future for everyone else.

As of now,

I have

I-130

I-131

I-485

I-765

I-864

And I am mostly done, but confused as why do I need to file I-765 and I dont even remember that where I read to fill out I-765 for MB Greencard.

Please advise, thank you in advance. Your effort and suggestions are appreciated.

All forms should be sent together.

Don't forget the G-325as (one for you, one for your wife)

Why you file the I-765: It's free to file with an I-485 application (apart from an hour of your time), and it's useful in case you decide you want to change your job, get laid off, or want to do some contracting on the side before you get the green card.

Also, do the I-693. I did my medical before I submitted everything, and put it all in together.

Question:

I-864 by my wife - What option should she use for Part 1 - Que 1? Answer a or e?

I am going to fill I-864A by my name, as second sponsor.

Do I need I-864 as well? And if yes, which line should I use in Q1? Ans e?

You do not fill out I-864A. You can add your income to your wife's I-864. Reread the instructions. She is the primary sponsor.

my wife needs to write

1 - A (I am the petitioner )

and I dont have to fill I-864A. and select 24-E and write my name.

Please correct me if I'm wrong.

So Do I need to write total amount of her and myself in 2009, 2010 and 20122 tax returns as needed in Q25?

Do I need to write My wife's Total income for year 2009, 2010 and 2011 only?

Or

Add my income with her and write total of both of us?

While filling out I-765, Should I select

"I am applying for" - option 1 (Permission to accept employment) ---- even I've H-1B already

And

Select ©(9)?
