Hey folks . . (VJers) . . My man's interview is 11/26 and we were going over questions and answers that the embassy may ask. He has two children (small) by two different mothers . . . His plans are to marry me and then at some point send for his children (if possible, one of the mothers is agreeable and one is not so far). Of course he will continue to provide for them from America. My question is can this situation hinder him from getting approved? He says that sometimes they do deny you if you have children . . can this be done in a K-1 visa situation? Thank you any information will be helpful and may stop me from losing sleep and my hair over this.

Thank you.

Vickie

Hi Tberta - I will share my experience but first congratulations!!

We were approved and my fiance has 6 children (5 of his own and 1 he has raised as his own). We listed them all on the 129F application when asked if he has children. When we got our interview letter it listed my fiance and ALL the children and we told them in person the day of the interview that we hoped they could visit in the future and possibly come to US at some point but there were no plans at this point. Our letters included words telling our intentions of support and future visits/immigrating also.

So just having children is not a reason they would deny you - the process is very detailed so as long as all is in order you should not have problems. That said, the embassy does have discretion on things so I still held my breath until he came out and said we were approved. Most times from what I have read here there are followup interviews if there is more paperwork needed or conflicting information in the application. I would think denial would be for reasons like failing a background check or something like that!

But hopefully more will chime in as they know the process MUCH more than I do. Best of luck and as hard as it is try not to worry. Make sure all is in order and keep the faith.

ONE LOVE

No, having kids will not hinder the visa unless there is something odd about the situation, such as they were left off the initial application, or they were conceived during your relationship with him.

Thank you.

Having children is not a requirement of K-1, and actually they do not know that he has children, unless you mention it in your statements with your petition.
