So since we are leaving in the middle of our process (see signature), we could apply for a K-3 spouse visa without cancelling our process? I will verify that at our Thursday InfoPass appointment. 240 dollars for peace of mind is worth it.

No... I would ask questions like this in the main forum so you can get better (or any) answers.

If you leave before the AP is approved and in your hand, the AOS will be denied for abandonment (unless she has a H1B or L visa). That is a waste of $1070. Your wife will be stuck outside the country and you will apply for a spousal visa (CR-1). K-3 is a dead visa type, and you will not get it.

You say you will join January filers. How do you think your wife will enter the country in January without AP? Does she have H1B?

I filed AOS for my wife on the 19th. Still waiting on a hard copy, text/email, and our check to be cashed. The only evidence we currently have they even got the package is they signed for it haha. Waiting sucks.

Lots to report. First, we went to our 8:15 appointment to explain our RFE (I-485) situation. I explained that I cannot fill out my joint tax return without her having an SSN, but can't get an SSN without having EAD approved. On the RFE, it states that until I give this past year's tax return, the EAD is on hold. She failed to see the chicken/egg scenario and we were unable to even get a number to talk to someone. Second failure was attempting to get an SSN from the SSA. The lady there said that my wife, F1 student (not allowed to work), needed employment authorization for an F1 student in order to get an SSN. I told her that we were married (didn't matter), that she does not work because she is a student (doesn't matter), can't fill out my taxes without her having a SSN or ITIN. This is when her eyes lit up and I finally saw joy in her face. ITIN? she asks, the IRS gives ITINs! Do you want THEIR information? Yes. So, now we are on the way to the IRS building to attempt the ITIN. Since we are so far away, I have my wife dial the RFE help number and half an hour later, we got someone on the phone. After verifying everything and explaining the whole tax/EAD thing, he said that we needed to expedite the EAD/AP card (which I was told was not possible by the first lady this morning). He then went through and filled out an expedite request for us over the phone, gave us a reference number, and told us that if we didn't hear anything by the 11th (Tuesday), to call back on the 12th with the reference number. He said that it will be approved/denied by then. Wound up just turning around and going to work rather than chance messing up what we finally got in place with trying to get an ITIN.

So we at least have a glimmer of hope shining through that we will be approved for the expedited EAD/AP. I just hope it doesn't go to someone like the first person we dealt with this morning.

I am fully aware of the result of leaving while in process without AP. We would have to begin the process of bringing a spouse into the country and adjust status. I am so done with looking at this ####### after everything we've been through already. If nothing comes of our latest attempt, I will have to start researching that process in more detail.

Did a successful walk-in biometrics today at the 60th street Brooklyn ASC. I went in around 8:20a.m, it was so easy, no questions asked. I was out of there in about 15 minutes. Exciting!!!

Praying for speedy EAD processing and interview appointment to follow.

Hope everyone's process is coming along fine.

today morning i received another SMS and email that my Case is in POST Decision Activity. And they have mailed my Approval Notice. I called up the USCIS Rep and he told me that he cannot see any updates of Card production.

Might be all these are just Random updates from USCIS. Untill i get anything in Hand i am not going to celebrate. Mostly i am also in the same boat with all of you as of now....

I just received a call about our problem with not having an SSN, can't file taxes, can't give a return for the I-485 without the taxes, etc. They said they will expedite the EAD and try to get the AP expedited as well. Hopefully, we get a combo card. He said to expect it within two weeks. Believe me, I would have rather not had all of the trouble with the impossible RFE than having to try the expedite route. I think the only reason why it will be getting expedited is because of the conundrum. I explained that I did send in the previous two years' tax returns instead of last year's (which is allowed) which seemed to help. I explained that because we are 'in process', we can't get issued an ITIN, which helped. Financial and religious reasons had no effect on the process.

Based on the initial text messages my wife has got her travel arrangements done for the 12th after Finger printing is done. Now if i do not receive the cards by tuesday we have to cancel her trip and she will not be able to go to India as her has no vacation at her schol till Next August.

Hey all,

So,I just came back from a successful walk-in at ( Whitehurst DR, Dallas). It took only about 10 mins. 5 mins to convince them (to let me in)and 5-6 mins for the process. I'd gone in at 3:35pm; the center closes at 4pm. Actually, I sneaked in. (Well, almost!)

They were reluctant initially, and I had to explain why I landed there unceremoniously ( all sweaty, panting for breath, cos I had jogged for over an hour trying to find the tiny building hidden behind a Cici's). Anyway, I was told outright near the gate that I should enter if I have an appointment ( I ignored). I was asked again why I came late and if I have an appointment (I ignored again). Then, it was my turn :D I announced loudly that I traveled and walked a great deal to be on time and requested the front desk to help me with my fingerprints. By this time the senior officer overheard us, she asked me why I didn't re-schedule for a later date, if not 12/18. I told her that's impossible, I want to get it done today, since you guys are not busy and I'm here before 4pm :P And lo! Suddenly she agreed and added that just this once, she'll do it. I was profusely thanking all the Immigration Gods and Goddesses, for this. Before I knew it, it was done.

Actually, My biometric notice has been sitting with my lawyer since 11/26. Damn! And I decided to go today for a walk-in :( That means I delayed it for 2 weeks :/ I was so determined to get this walk-in done successfully (Had heard from several others that this particular location doesn't take walk-in's.) Yaay, it's done! :star:

Few notes:

1) Either go super early in the morn or before closing time. They'll be less busy at these times.

2) Unless you want to regret later, dress well/look good before your walk-in. This advice is for Women and for Men! Cos these are the pics that will go on your card eventually.

3)Even if they deny entry at the start, cite your reasons and request them to accommodate you.

4)I took my passport as an ID and the biometric notice. That's all.

Overall, it was super easy and fun. Praying that all of us achieve success in our endeavors.
