Hi,

I'm not really sure where to post my question..

but basically I'm a Danish citizen married to an American citizen. If we apply for residency in Denmark instead of the States, will I be able to travel to the States to visit if I bring proof that we have applied for my husband's residency in Denmark, a copy of my lease etc? What are the chances they will let me in?

Hope someone can help me with this fast as we need to buy a plane ticket asap!

Yes you can travel to the US.

I travel to Canada all of the time and they've told me in the past that when we file our I-130, that I should start bringing that is proof as it will only help as ties to the US.

So are you Canadian married to an American? Do the immigration officers qustion you a lot?

No, I am the USC as stated in my signature.

My husband is Canadian.

Going into the US, my husband is red flagged and we get questioned EVERY time

Make sure you carry lots of ties to denmark aside from the paperwork filing.

Carry letters from your employer stating when you'll return, a lease or mortgage, etc.

Hey Ewill, you decided on Danish residency instead?

Yes, you can can visit the United State under the ESTA (http://denmark.usembassy.gov/non-immigrant_visas/visa-or-esta-.html) read through the page and fill out the linked form at the bottom (https://esta.cbp.dhs.gov/esta/) you should get an automated approval response almost immediately. Bring with you evidence of strong ties to Denmark to prove that you are truly visiting and not intending to migrate (stay) in the US when you visit. Your lease, banks statements, last pay stub, etc. Your husband's residency application may help, but the immigration officer is more interested in your ties to Denmark rather than your spouses'. They may or may not ask questions when you arrive at the airport but that's really up to each immigration officer, just always be truthful with your answers.

Also, I don't have a job, Im still on maternity leave but receives money from the government, so I have those 'paychecks' to show. Also I have a lease, but that's all I can really think of. What kind of bank statements should I bring? Any suggestions on what else to bring are appreciated!

I have realised that if you have a good past travel history they will not ask a lot of questions.

Only give answers for questions they ask and answer truthfully. I had not issues in the 4 times that I travelled while my I-130 was being processed. The questions were usually:

1. What is the purpose of your visit?

2. what do you do in your country (employment)?

3. How long do you intend to stay?

4. Do you have family here?

December 15, 2012: POE Atlanta....................became USC July 2016!!!!

I'd advise to just answer what they ask when they ask, just as Velrich said. And be calm :)

As for ties here are some suggestions:

- Do the maternity payments have a start and end date?

If so, can you get a copy where it states that, for example when you applied for it and when it will expire.

-Are you on leave from work?

If so, can you get a letter from your employer stating you are on maternity leave from x date to x date and you have a job waiting for you on the date your maternity leave expires.

If not, then that may be a sticking point if you don't have a job waiting for you. But that may be where your husband's paperwork (his job and DK residency application) might come in handy.

- Take your bank statements showing your current balance (maybe ones from the last few months too) of checking, savings, and any other types of assets (stocks, pension, etc.)

- Copy of your lease should clearly state the lease period.

Thanks guys!

And thank you for your suggestions. My lease doesn't have an end date.. leases generally don't overhere. I can rent my apartment as long as I want. So I don't know if a copy of my lease will be of any help?

My maternity leave runs out in February actually..bad timing :( But then after that my union pays me until I find a job..maybe I could bring a copy of a document stating that I'm a member of the union.. but again, don't know if that would help. Another thing is, my son is signed up for day care from february 1st..maybe I could bring proof of that.

I don't really have any assets, so a bank statement will only show my debt and a savings account for my son plus of course my checkings account..

I'm Norwegian, married to an American. I've entered on the VWP four times since getting married. I have never been questioned beyond the basic normal questions. Last time I entered was the only time I've been asked for any type of proof of return - She just wanted to see my return ticket.

You'll be fine. Some type of proof is always recommended, but you most likely won't be asked for it.
